Surplus state real property: disposal.
Existing law authorizes the Director of General Services to dispose of surplus state real property where that property is not needed by another state agency and the Legislature has authorized disposal of the property. Existing law also specifies the manner in which the department is to dispose of surplus state real property.
This bill would authorize the director to dispose of specified state properties pursuant to these provisions, subject to conditions relating to the approval of the disposal to the extent the property is subject to outstanding bonds.
The California Constitution requires that the proceeds from the sale of surplus state property be used to pay the principal and interest on bonds issued pursuant to the Economic Recovery Bond Act, until the principal and interest on those bonds are paid in
full, the final payment of which was made in the 2015–16 fiscal year, after which these proceeds are required to be deposited into the Special Fund for Economic Uncertainties, a continuously appropriated fund.
By increasing the amount transferred into the Special Fund for Economic Uncertainties, a continuously appropriated fund, this bill would make an appropriation.

The people of the State of California do enact as follows:
SECTION 1.
(a) The Director of General Services may sell, exchange, sell combined with an exchange, or lease for fair market value, upon those terms and conditions as the Director of General Services determines are in the best interest of the state, all or any part of the following real properties pursuant to Section 11011.1 of the Government Code:(1) The property consisting of approximately 2.79 acres and improvements, known as the Department of General Services’ Fresno Water Resources Building, located at 3374 East Shields Avenue, in Fresno, Fresno County, Assessor’s Parcel Number 00445-0020-13T.
(2) The property consisting of approximately 1.64 acres and
improvements, known as the Department of General Services’ Alfred E. Alquist State Office Building, located at 100 Paseo De San Antonio, in San Jose, Santa Clara County, Assessor’s Parcel Number 00467-0046-093.
(3) The property consisting of approximately 2.11 acres and improvements, known as the Department of General Services’ Stockton State Office Building, located at 31 East Channel Street, in Stockton, San Joaquin County, Assessor’s Parcel Number 00139-0100-010.
(4) The property consisting of approximately 2.25 acres and improvements, known as the California Air Resources Board’s Haagen-Smit Laboratory, located at 9528 Telstar Avenue, in El Monte, Los Angeles County, Assessor’s Parcel Number 8581-001-911.
(b) To the extent that bonds issued by the State Public Works Board that involve a property to be sold,
leased, or exchanged pursuant to this section are outstanding at the time the purchase, lease, or exchange agreement is ready for execution, the board shall approve the purchase, lease, or exchange agreement and all costs associated with the defeasance of the bonds shall be paid from the proceeds from the transaction.
