LEGISLATIVE COUNSEL'S DIGEST
Existing law permits an authorized employee of a county social services department to disclose the name and residential address of elderly or disabled clients to police, fire, or paramedical personnel, or other designated emergency services personnel, in the event of a public safety emergency that necessitates the possible evacuation of the area in which those elderly or disabled clients reside. Existing law specifies that public safety emergencies include, but are not limited to, events that jeopardize the immediate physical safety of county residents.
This bill would additionally permit those individuals’ telephone numbers and e-mail addresses to be disclosed and would specifically identify a public safety power shut-off as a public safety emergency. The bill
would require a county social services agency that intends to disclose information as described above to notify elderly or disabled individuals receiving services of that fact and give the individual the option to opt out of having that information disclosed. The bill would limit the use of the disclosed information to providing emergency services in the event of a public safety emergency described above.

The people of the State of California do enact as follows:
SECTION 1.
Article 24 (commencing with Section 70050) is added to Chapter 2 of Part 42 of Division 5 of Title 3 of the Education Code, to read:Article 24. CalServe Higher Education Grant Act
70050.
This article shall be known, and may be cited, as the CalServe Higher Education Grant Act.70051.
The CalServe Higher Education Grant Program Fund is hereby established in the State Treasury. All moneys appropriated for the CalServe Higher Education Grant Program shall be deposited into the fund and appropriated by the Legislature to the commission for the program.70052.
The CalServe Higher Education Grant Program is hereby established under the administration of the commission to make higher education more affordable and encourage students to serve their communities and state as CalServe volunteers.70053.
Unless context otherwise requires, for purposes of this article, the following definitions apply:70054.
Commencing with the 2023–24 academic year, the commission shall award a grant to an eligible student who submits an application for the grant. The amount of the award shall be the remaining balance of mandatory systemwide tuition and fees to be paid by the student after all other federal, state, or institutionally administered grants or fee waivers received by the student have been used. A participating student shall only be eligible to receive an award under this article for a maximum of four academic years. The commission shall award the grant on a yearly basis.70055.
A student shall meet all of the following requirements to be eligible for a grant under this article:70056.
The commission shall adopt, as necessary, application procedures, forms, administrative guidelines, and other requirements for purposes of implementing and administering the program.70057.
This act shall not be interpreted to impact or interfere with pilot programs run by CalServe to provide financial aid to students in exchange for service as a volunteer.SEC. 2.
The heading of Chapter 5.6 (commencing with Section 8390) is added to Division 1 of Title 2 of the Government Code, to read:CHAPTER 5.6. CalServe

Section 8390 is added to the Government Code, to read:8390.
(a) CaliforniaVolunteers, as established by Executive Order S-24-06, is hereby reestablished in state government as a state agency. CaliforniaVolunteers is hereby renamed CalServe and is not established in the office of the Governor.SEC. 4.
Section 8391 is added to the Government Code, to read:8391.
For purposes of this chapter, all of the following definitions apply:SEC. 5.

(a) There are continued in existence the positions of Executive Director of CaliforniaVolunteers, hereby renamed Executive Director of CalServe, and Deputy Director of CaliforniaVolunteers, hereby renamed Deputy Director of CalServe.SEC. 6.
Section 8393 is added to the Government Code, to read:8393.
(a) There is continued into existence a Board of Commissioners under CaliforniaVolunteers, hereby named the CalServe Commission.SEC. 7.
The heading of Chapter 5.6 (commencing with Section 8400) of Division 1 of Title 2 of the Government Code is repealed.SEC. 8.
Section 8400 of the Government Code is amended to read:8400.

(b)The authority granted in subdivision (a) shall expire if the Governor rescinds Executive Order S-24-06 or otherwise rescinds the establishment of CaliforniaVolunteers.
(a)(1)Notwithstanding Section 10850, an authorized employee of a county social services department may disclose the name, residential address, telephone number, and email address of elderly or disabled individuals receiving services to police, fire, paramedical personnel, or other designated emergency services personnel, in the event of a public safety emergency that necessitates the possible evacuation of the area in which those elderly or disabled clients reside. Those public safety emergencies include, but are not limited to, fires, earthquakes, gas leaks, bomb scares, public safety power shut-offs, and other natural or human-made occurrences that
jeopardize the immediate physical safety of county residents.
(2)If a county social services agency intends to disclose information pursuant to paragraph (1), it shall notify elderly or disabled individuals receiving services, at the time the individual is enrolled in services or at the time of the agency’s next contact with the individual, whichever comes first, of that fact. The individual shall have the option to opt out of having their name, residential address, telephone number, and email address disclosed as described in paragraph (1).
(3)Information disclosed pursuant to
paragraph (1) shall be used only by the receiving entity to provide emergency services in the event of a public safety emergency that necessitates the possible evacuation of the area in which an elderly or disabled individual resides.
(b)The Director of Social Services shall seek any federal approval necessary to implement subdivision (a).
(c)Subdivision (a) shall be implemented only if the director executes a declaration, that shall be retained by the director, stating that any federal approval required for implementation of subdivision (a) has been obtained, and only for the duration of that approval.
