An act to add and repeal Section 14519 of the Government Code, relating to aviation.

SB 258, as amended, Roth. General aviation airports: funding needs assessment.
Existing law requires the Division of Aeronautics in the Department of Transportation, in consultation with certain transportation planning agencies, to prepare a California Aviation System Plan with prescribed elements. Existing law requires the division to submit the plan to the California Transportation Commission, to revise biennially the capital improvement plan element of the plan, and to revise the remainder of the plan every 5 years. Existing law requires the commission to adopt the plan or to revise and adopt the plan.
This bill would require the commission to prepare a funding needs assessment for the state’s general aviation airports. As part of the funding needs assessment, the bill would require the commission to forecast the expected revenue to pay for the costs identified in the needs assessment, any shortfall in revenue to cover the costs, and recommendations on how any shortfall should be addressed. The bill would require the funding needs assessment to be consistent with informed by the California Aviation System Plan and the most recent capital improvement plan. The bill would require the commission to submit the funding needs assessment to the Legislature on or before January 1, 2026.

The people of the State of California do enact as follows:


SECTION 1.

 Section 14519 is added to the Government Code, to read:

14519.
 (a) (1) The commission shall prepare a funding needs assessment for the state’s general aviation airports. As part of the funding needs assessment, the commission shall forecast the expected revenue, including federal, state, and local revenues, to pay for the costs identified in the funding needs assessment, any shortfall in revenue to cover the costs, and recommendations on how any shortfall should be addressed.
(2) The funding needs assessment shall be consistent with informed by the California Aviation System Plan prepared by the department pursuant to Section 21701 of the Public Utilities Code, and the most recent capital improvement plan developed pursuant to Section 21704 of the Public Utilities Code.
(3) The funding needs assessment shall include a description of funding needs related to topics that include, but are not limited to, safety, maintenance, improvements to address future air traffic, public safety operations, wildfire protection and prevention activities, the impacts of climate change, mitigation of community impacts from airport activities, and the deployment of new technology, including electric zero- and near-zero emission fuels and vertical takeoff and landing aircraft.
(4) In developing the funding needs assessment, the commission may use existing reports or analyses.
(5) In developing the funding needs assessment, the commission shall consult with relevant stakeholders, including, but not limited to, the department, the Federal Aviation Administration, the airport industry, users of general aviation airports, and appropriate local and regional governments.
(b) The commission shall submit the needs assessment to the Legislature on or before January 1, 2026.
(c) (1) The needs assessment report to be submitted pursuant to subdivision (b) shall be submitted in compliance with Section 9795.
(2) Pursuant to Section 10231.5, this section is repealed on January 1, 2030.
