   An act to add Section 14632 to the Government Code, relating to
the State Capitol Park, and making an appropriation therefor.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1297, as introduced, Blakeslee. State Capitol Park: memorial
plaque.
   Existing law prescribes various duties for the Department of
General Services in connection with development and maintenance of
the park around the State Capitol Building. Existing law establishes
the Department of Veterans Affairs, which is responsible for
administering various programs and services for the benefit of
veterans.
   This bill would require the Department of Veterans Affairs to plan
and construct a memorial plaque in the State Capitol Park, in
consultation with the Department of General Services, to honor
California veterans who have fought and served in the War in Iraq.
The bill would require the memorial plaque and its maintenance to be
funded through private donations. The bill would require donations
received by the Controller for those purposes to be deposited in the
War in Iraq Memorial Plaque Fund, which the bill would create as a
continuously appropriated fund for that purpose, thereby making an
appropriation. The bill would prohibit construction or affixion of
the memorial plaque until the Department of Veterans Affairs has
determined that sufficient private funding is available to construct
the memorial plaque.
   Vote: majority. Appropriation: yes. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 14632 is added to the Government Code, to read:

   14632.  (a) Notwithstanding any other law, the Department of
Veterans Affairs shall plan and construct a memorial plaque in the
State Capitol Park, in consultation with the department, to honor
California veterans who have fought and served in the War in Iraq.
   (b) The Department of Veterans Affairs shall consult with the
department to identify an appropriate location for the memorial
plaque.
   (c) The Department of Veterans Affairs, in consultation with the
department, shall establish a schedule for the design, construction,
and dedication of the memorial plaque, and shall hold an event for
the dedication of the memorial plaque.
   (d) The Department of Veterans Affairs and the department shall
approve the design of the memorial plaque.
   (e) The Department of Veterans Affairs and the department shall
not begin construction or affixion of the memorial plaque until the
Department of Veterans Affairs has determined that sufficient private
funding is available to construct the memorial plaque.
   (f) The planning, construction, and maintenance of the memorial
plaque shall be funded exclusively through private donations for that
purpose. Donations received by the Controller shall be deposited
into the War in Iraq Memorial Plaque Fund, which is hereby created in
the State Treasury. Notwithstanding Section 13340, moneys in the
fund shall be continuously appropriated to the Department of Veterans
Affairs for the purposes specified in this section, including
maintenance.
