BILL NUMBER: SB 1223 INTRODUCED BILL TEXT INTRODUCED BY Senator Wright FEBRUARY 20, 2014 An act to amend Section 17505 of the Penal Code, relating to weapons. LEGISLATIVE COUNSEL'S DIGEST SB 1223, as introduced, Wright. Weapons: advertising. Existing law prohibits the possession of various weapons and related products, including machineguns and assault weapons. Existing law makes it a crime for any person, as defined, to advertise the sale of any weapon or device, the possession of which is prohibited, including machineguns and assault weapons, in any newspaper, magazine, circular, form letter, or open publication that is published, distributed, or circulated in California, or on any billboard, card, label, or other advertising medium, or by means of any other advertising device. This bill would add as an element of this crime that a person intended for a weapon or device to be sold in this state to any person prohibited from possessing that weapon or device. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 17505 of the Penal Code is amended to read: 17505. It shall be unlawful for any person, as defined in Section 16970, to advertise the sale of any weapon or device, the possession of which is prohibitedintended to be sold in this state to any person prohibited from possessing that weapon or device by Section 18710, 20110, 30315, 30320, 32625, or 33410, by Article 2 (commencing with Section 30600) of Chapter 2 of Division 10 of Title 4, or by any provision listed in Section 16590, in any newspaper, magazine, circular, form letter, or open publication that is published, distributed, or circulated in this state, or on any billboard, card, label, or other advertising medium, or by means of any other advertising device.
