   An act to amend Section 9454 of the Civil Code, relating to public
works contracts.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1106, as introduced, Berryhill. Public works contracts.
   Existing law authorizes specified persons that have not been paid
in full to give a stop payment notice to the public entity or assert
a claim against a payment bond. Existing law provides that a person
that willfully gives a false stop payment notice to the public entity
or that willfully includes in the notice work not provided for the
public works contract for which the stop payment notice is given
forfeits all right to participate in the distribution of funds
withheld under the stop payment notice.
   This bill would make technical, nonsubstantive changes to the
latter provision.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 9454 of the Civil Code is amended to read:
   9454.   A   Any  person that willfully
gives a false stop payment notice to the public entity  , 
or that willfully includes in the notice work not provided for the
public works contract for which the stop payment notice is given 
,  forfeits all right to participate in the distribution under
Section 9450.
