BILL NUMBER: SB 1106 AMENDED BILL TEXT AMENDED IN SENATE APRIL 10, 2014 INTRODUCED BY Senator Berryhill FEBRUARY 19, 2014An act to amend Section 9454 of the Civil Code, relating to public works contracts.An act to add Section 1159.1 to the Labor Code, relating to agricultural labor relations. LEGISLATIVE COUNSEL'S DIGEST SB 1106, as amended, Berryhill.Public works contracts.Agricultural labor relations: certified labor organizations: reports. Existing law, the Alatorre-Zenovich-Dunlap-Berman Agricultural Labor Relations Act of 1975, grants agricultural employees the right to form and join labor organizations and engage in collective bargaining with respect to wages, terms of employment, and other employment conditions. The act provides for a secret ballot election for employees in agricultural bargaining units, as defined, to select labor organizations to represent them for collective bargaining purposes. The act creates the Agricultural Labor Relations Board and requires it, among other things, to certify the election of a labor organization, as specified. This bill would require a certified labor organization to submit an annual report to the board listing the names of employers with whom negotiations under the act are in progress but not yet completed, including a description of the progress of negotiations between the labor organization and the employer, as specified.Existing law authorizes specified persons that have not been paid in full to give a stop payment notice to the public entity or assert a claim against a payment bond. Existing law provides that a person that willfully gives a false stop payment notice to the public entity or that willfully includes in the notice work not provided for the public works contract for which the stop payment notice is given forfeits all right to participate in the distribution of funds withheld under the stop payment notice.This bill would make technical, nonsubstantive changes to the latter provision.Vote: majority. Appropriation: no. Fiscal committee:noyes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1159.1 is added to the Labor Code , to read: 1159.1. In addition to any other reporting requirement under this part or its implementing regulations, a certified labor organization shall submit an annual report to the board listing the names of employers with whom negotiations under this part are in progress but not yet completed, including a description of the progress of negotiations between the labor organization and the employer. The report shall include the requests made by the union to bargain and the dates of meetings between the labor organization and the employer.SECTION 1.Section 9454 of the Civil Code is amended to read: 9454. Any person that willfully gives a false stop payment notice to the public entity, or that willfully includes in the notice work not provided for the public works contract for which the stop payment notice is given, forfeits all right to participate in the distribution under Section 9450.
