   An act to add  and repeal  Section 66940.7
 of   to  the Education Code, relating to
postsecondary education.

   AB 895, as amended, Rendon. Postsecondary education: online
education task force.
   The Donahoe Higher Education Act sets forth, among other things,
the missions and functions of California's public and independent
segments of higher education, and their respective institutions of
higher education. Provisions of the act establish the California
Postsecondary Education Commission for, among other purposes, the
collection of data pertinent to the planning and coordination of the
higher education system.
   Existing law establishes the California Distance Learning Policy,
which sets forth the guiding goal and principles for the utilization
of technology in California postsecondary education.
   This bill would establish the California Postsecondary Online
Education Task Force, to consist of  11   15
 members to be  appointed   selected, as
specified,  on or before March 31, 2014. This bill would require
the task force to evaluate and collect data on  the current
status of postsecondary online education in both public and private
institutions, as specified, examine online education programs in
other states, and analyze methods to implement online education
programs in California postsecondary institutions. This bill would
require the task force   specified topics, and  to
submit a report on or before  an unspecified date 
 January 1, 2016, and every 2 years thereafter,  to the
Legislature with  information obtained in its examination of
those topics and  recommendations of innovative online education
methods.  The bill would repeal these provisions on an
unspecified date.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 66940.7 is added to the Education Code, to
read:
   66940.7.  (a) The California Postsecondary Online Education Task
Force is hereby established. As used in this section, "task force"
means the California Postsecondary Online Education Task Force.
   (b) The task force shall consist of  11  15
 members, who shall be  appointed  
selected  on or before March 31, 2014, in accordance with the
following: 
   (1) Three representatives from the business community with
expertise in business and education technology, appointed by the
Governor, the Speaker of the Assembly, and the Senate Committee on
Rules, respectively.  
   (2) Three members shall be appointed by the Governor, one from
each of the Board of Governors of the California Community Colleges,
the Regents of the University of California, and the Trustees of the
California State University.  
   (3) A faculty member from the California Community Colleges,
appointed by the Governor.  
   (4) A faculty member from the California State University,
appointed by the Senate Committee on Rules.  
   (5) A faculty member of the University of California appointed by
the Speaker of the Assembly.  
   (6) The Superintendent of Public Instruction or his or her
designee.  
   (7) The Lieutenant Governor or his or he designee.  
   (1) Two faculty members from the California Community Colleges,
selected by the Academic Senate for California Community Colleges.
 
   (2) Two faculty members from the California State University,
selected by the Academic Senate of the California State University.
 
   (3) Two faculty members from the University of California,
selected by the Academic Senate, University of California.  

   (4) One member of the nonfaculty staff of the California Community
Colleges, selected by the Chancellor of the California Community
Colleges.  
   (5) One member of the nonfaculty staff of the California State
University, selected by the Chancellor of the California State
University.  
   (6) One member of the nonfaculty staff of the University of
California, selected by the President of the University of
California.  
   (7) One administrative officer or employee of the California
Community Colleges, selected by the Chancellor of the California
Community Colleges.  
   (8) One administrative officer or employee of the California State
University, selected by the Chancellor of the California State
University.  
   (9) One administrative officer or employee of the University of
California, selected by the President of the University of
California.  
   (10) One student of the California Community Colleges, selected by
the Chancellor of the California Community Colleges from a list of
the names of at least two students submitted to the chancellor by the
governing board of any statewide student organization that
represents the students of the California Community Colleges and the
student body organizations of the campuses of the California
Community Colleges.  
   (11) One student of the California State University, selected by
the Chancellor of the California State University from a list of the
names of at least two students submitted to the chancellor by the
governing board of any statewide student organization that represents
the students of the California State University and the student body
organizations of the campuses of the California State University.
 
   (12) One student of the University of California, selected by the
President of the University of California from a list of the names of
at least two students submitted to the president by the governing
board of any statewide student organization that represents the
students of the University of California and the student body
organizations of the campuses of the University of California. 

   (13) A member of the task force shall serve at the pleasure of the
entity that selected him or her. 
   (c) The duties of the task force shall include, but not 
necessarily  be limited to,  all of  the following:
   (1) Evaluating and collecting data on the status of postsecondary
online education in both public and private  institutions
  institutions, including out-of-state online education
providers, offering online courses  in California, including,
but not  necessarily  limited to,  all of  the
following:
   (A) The number of students, course offerings, types of course
offerings, and full degree programs in each institution.
   (B) The average  amount of  student loan debt and the
 student loan  status  of repayment of these
loans  .
   (C) The amount of money invested per student per program.
   (D) The completion rate of students enrolled full time in online
courses and part time in online courses.
   (E) Data on student demographics, including, but not 
necessarily  limited to, matriculated compared to
nonmatriculated students, and students enrolled full time in online
courses compared to students enrolled part time in online courses.
   (F) Data on faculty teaching online, including, but not 
necessarily  limited to, tenure status, years of teaching in a
classroom compared to online teaching,  age,  and
the number of classes taught. 
   (2) Examining postsecondary online education programs in other
states.  
   (3) Analyzing methods to implement online 
    (2)     Identifying the role of online
 education programs in  California postsecondary
institutions.   California's public postsecondary
education system.  
   (3) Identifying evidence-based best practices, including, but not
necessarily limited to, both of the following:  
   (A) Identifying courses best and least suited for online
education.  
   (B) Identifying students best suited for online education. 

   (4) Determining and describing the fiscal impact of online
education on all of the following:  
   (A) The students.  
   (B) The three segments of public postsecondary education. 

   (C) The state General Fund.  
   (5) Identifying resources, including, but not necessarily limited
to, fiscal resources, labor and staff, and technological
infrastructure and support, needed for the effective delivery of
online education.  
   (6) Analyzing methods to implement online education programs in
California postsecondary institutions. 
   (d)  The   Notwithstanding Section 10231.5 of
the Government   Code, the  task force shall submit a
report, on or before  ______   January 1, 2016,
and every two years thereafter  , to the  Legislature
with   Legislature. These reports shall include, but not
necessarily be limited to, information obtained pursuant to
subdivision (c), and  recommendations of innovative online
education methods.
   (e) The report required pursuant to subdivision (d) shall be
submitted in compliance with Section 9795 of the Government Code.

   (f) This section shall remain in effect only until ____, and as of
that date is repealed, unless a later enacted statute, that is
enacted before ____, deletes or extends that date.
