BILL NUMBER: AB 667 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Block FEBRUARY 25, 2009 An act to amend Section 104830 of, and to add Section 104762 to, the Health and Safety Code, relating to oral health. LEGISLATIVE COUNSEL'S DIGEST AB 667, as introduced, Block. Topical flouride application. Existing law requires that pupils of public and private elementary and secondary schools, except community colleges, be offered the opportunity to receive, within the school year, the topical application of flouride or other decay-inhibiting agent to the teeth, as specified. Existing law requires the application to be under the direction of a dentist and allows for self-application. This bill would specifically include flouride varnish in the topical applications that may be used and allow application by any person. The bill would also permit any person to apply topical flouride, including flouride varnish, or other decay-inhibiting agent to the teeth of a person being served in a public health setting or program that is created or administered by a state or local governmental entity, as specified. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 104762 is added to the Health and Safety Code, to read: 104762. Within a public health setting or a public health program that is created or administered by a state or local governmental entity any person may apply topical flouride, including flouride varnish, or other decay-inhibiting agent to the teeth of individuals who are being served in that setting or program, according to the prescription and protocol issued and established by a physician or dentist. SEC. 2. Section 104830 of the Health and Safety Code is amended to read: 104830. Pupils of public and private elementary and secondary schools, except pupils of community colleges, shall be provided the opportunity to receive within the school year the topical application of fluoride , including flouride varnish, or other decay-inhibiting agent to the teeth in the manner approved by the department. The program of topical application shall be under the general direction of a dentist licensed in the state and may include application by a teacher, parent, volunteer, or other person, or self-application , if appropriate .
