   An act relating to state property.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 495, as introduced, Logue. State property: Harts Mill Forest
Fire Station: transfer.
   Existing law authorizes the Director of General Services to
execute grants to real property belonging to the state in the name
and upon behalf of the state, whenever the sale or exchange of real
property is authorized or contemplated by law, if no other state
agency is specifically authorized and directed to execute the grants.

   This bill would require the director to transfer state property,
known as the Harts Mill Forest Fire Station (Old), to the County of
Butte, as prescribed. This bill would also require the County of
Butte to use the property for parks and open-space purposes.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  (a) Notwithstanding any other law, the Director of
General Services shall transfer to the County of Butte state property
that consists of approximately 2.76 acres, known as the Harts Mill
Forest Fire Station (Old), located at 9476 Oro-Quincy Highway, in
Berry Creek, Butte County.
   (b) The transfer shall be completed at no cost to the County of
Butte, other than reasonable costs incurred by the Department of
General Services in performing the transfer.
   (c) As a condition of receiving the property, the County of Butte
shall accept the property as is, and shall maintain the property in
perpetuity for parks and open-space purposes within the meaning of
paragraph (4) of subdivision (c) of Section 11011.1 of the Government
Code. Notwithstanding any other law that limits reversionary rights
to real property, including, but not limited to, Chapter 5
(commencing with Section 885.010) of Title 5 of Part 2 of Division 2
of the Civil Code, title to this property shall revert to the
possession, control, and ownership of the state if the condition in
this subdivision is violated. This condition shall be included in the
quitclaim deed to the County of Butte.
   (d) The transfer of property pursuant to this section shall be
subject to the requirements in paragraph (1) of subdivision (k) of
Section 11011 of the Government Code.
