LEGISLATIVE COUNSEL'S DIGEST
Existing law creates the Agriculture Trust Fund, the activities of which are subject to audit at least once every 2 years. Existing law provides that the trust accounts in the fund are to be used for the purpose of implementing and continuing agricultural programs, as specified.
This bill would provide that the Agriculture Trust Fund shall be audited at least once every year.

The people of the State of California do enact as follows:
SECTION 1.
Article 9.5 (commencing with Section 35975) is added to Chapter 2 of Part 2 of Division 15 of the Food and Agricultural Code, to read:Article 9.5. Ultra-Filtered Milk Products
35975.
(a) For purposes of this article, “ultra-filtered milk products” are market milk products resulting from the filtration of milk to alter the relative quantities of milk solids, including proteins, lactose, and minerals, but not including fat components.SEC. 2.
No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.All trust fund activities shall be subject to an audit at least once every year by an auditing firm selected by the secretary in accordance with Chapter 2 (commencing with Section 10290) of Part 2 of Division 2 of the Public Contract Code. A copy of the audit shall be delivered to the
secretary within 30 days after completion.
