An act to amend Section 253.1 of, and to add Section 253.9 Sections 253.9 and 622.5 to, the Streets and Highways Code, relating to highways.


LEGISLATIVE COUNSEL'S DIGEST


AB 29, as amended, Holden. State Highway Route 710.
Existing law provides that the Department of Transportation has full possession and control of all state highways and associated property. Existing law designates and describes state highway routes, and also describes the state highway routes in the California freeway and expressway system, including all of Route 710 in the County of Los Angeles.
This bill would remove the portion of Route 710 located north of Route 10 from the California freeway and expressway system.
The bill would require the department and the Los Angeles County Metropolitan Transportation Authority, in direct consultation and agreement with local governments of cities and communities whose jurisdiction includes Route 710, to implement projects in the SR-710 North Project Study Area and to establish the terms for the disposal of real property in the areas between the stub immediately north of the junction of Interstate 10 and Route 710 in the City of Alhambra and the current stub immediately south of Route 210 in the City of Pasadena. The bill would give the Cities of Alhambra, Pasadena, and South Pasadena the right of first refusal to acquire real property within their respective city limits after projects have been implemented according to the process described above.
By imposing new duties on local public officials, the bill would create a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 253.1 of the Streets and Highways Code is amended to read:

253.1.
 The California freeway and expressway system shall include:
Routes 5, 6, 7, 8, 10, 11, 14, 15, 18, 24, 28, 32, 34, 37, 40, 44, 47, 48, 50, 51, 52, 53, 54, 55, 56, 57, 59, 60, 61, 63, 65, 67, 68, 70, 71, 73, 74, 78, 80, 81, 83, 85, 87, 88, 89, 90, 93, 97, 100, 102, 103, 105, 107, 108, 118, 121, 122, 124, 125, 126, 134, 136, 139, 140, 145, 148, 149, 154, 156, 161, 163, 164, 179, 181, 183, 184, 199, 205, 210, 215, 217, 221, 223, 230, 232, 234, 235, 237, 238, 239, 241, 242, 247, 249, 251, 257, 258, 259, 261, 280, 330, 371, 380, 405, 505, 580, 605, 680, 780, 805, 880, and 980 in their entirety.

SEC. 2.

 Section 253.9 is added to the Streets and Highways Code, to read:

253.9.
 The California freeway and expressway system shall also include Route 710 from:
(a) Route 47 to Route 1.
(b) Route 1 to Route 10.

SEC. 3.

 Section 622.5 is added to the Streets and Highways Code, to read:

622.5.
 (a) The department and the Los Angeles County Metropolitan Transportation Authority shall, in direct consultation and agreement with the City of Alhambra, the City of Pasadena, the City of South Pasadena, those communities with jurisdiction in the 90032 ZIP Code, those communities in the unincorporated areas of the County of Los Angeles with jurisdiction in the 90063 ZIP Code, and the California State University, Los Angeles, do both of the following:
(1) Implement projects in the SR-710 North Project Study Area.
(2) Establish the terms for the disposal of real property in the areas between the stub immediately north of the junction of Interstate 10 and Route 710 in the City of Alhambra and the current stub immediately south of Route 210 in the City of Pasadena.
(b) The Cities of Alhambra, Pasadena, and South Pasadena shall have the right of first refusal to acquire real property within their respective city limits after projects have been implemented according to the process described in subdivision (a).
(c) This section does not apply to real property being disposed of through Article 8.5 (commencing with Section 54235) of Chapter 5 of Part 1 of Division 2 of Title 5 of the Government Code.

SEC. 4.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
