The Passenger Charter-party Carriers’ Act provides for the regulation of transportation network companies by the Public Utilities Commission. The act defines a “transportation network company” to mean an organization operating in California that provides prearranged transportation services for compensation using an online-enabled application or platform to connect passengers with drivers using a personal vehicle, as provided. The act also defines a “participating driver” as any person who uses a vehicle in connection with a transportation network company’s online-enabled application or platform to connect with passengers. The act requires a participating driver to possess a valid driver’s license, as specified. Under existing law, a violation of the act is a crime.

Proposition 22, approved by the voters at the November 3, 2020, statewide general election, requires a network company, including a transportation network company, to require an app-based driver to complete specified safety training before allowing the app-based driver to use the network company’s online-enabled application or platform.

This bill would state the intent of the Legislature to enact subsequent legislation that would require participating drivers for a transportation network company to complete an annual safety certificate for transporting passengers. require the commission, in consultation with the Department of Motor Vehicles, to create a safety course no later than October 1, 2023, on safe driving and passenger safety for participating drivers. The bill would require a transportation network company, on and after July 1, 2024, to require a participating driver to complete the safety course once every 2 years as a condition of using the transportation network company’s online-enabled application or platform to connect with passengers. Because a violation of this requirement under the act would be a crime, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.

The people of the State of California do enact as follows:


SECTION 1.

 Section 5445.4 is added to the Public Utilities Code, to read:

5445.4.
 (a) The commission, in consultation with the Department of Motor Vehicles, shall, no later than October 1, 2023, create a safety course on safe driving and passenger safety for participating drivers.
(b) On and after July 1, 2024, a transportation network company shall require a participating driver to complete the safety course created pursuant to subdivision (a) once every two years as a condition of using the transportation network company’s online-enabled application or platform to connect with passengers.

SEC. 2.

 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
SECTION 1.

It is the intent of the Legislature to enact subsequent legislation that would require participating drivers for a transportation network company to complete an annual safety certificate for transporting passengers.
