An act to add Article 1.5 (commencing with Section 8010) to Chapter 1 of Part 1 of Division 8 of Section 8042 to the Elections Code, relating to elections.

AB 2577, as amended, Bigelow. Elections: state offices: uniform candidate filing system. uniform filing forms.
Existing law prohibits a candidate’s name from being printed on a primary election ballot unless the candidate delivers, by the 88th day before the primary election, a declaration of candidacy and nomination papers signed by a specified number of voters to the elections official in the county for which the documents were circulated. Existing law requires a candidate to deliver the declaration of candidacy to the elections official of the candidate’s county of residence and to deliver nomination papers to the elections official of the county in which the signer resides.
This bill would require the Secretary of State to establish a uniform system for a candidate to file for a state office. The bill would require the system to permit a candidate for state office to file both the declaration of candidacy and the nomination papers with the Secretary of State. uniform filing forms for a candidate to use when filing a declaration of candidacy and nomination papers.

The people of the State of California do enact as follows:


SECTION 1.

 Section 8042 is added to the Elections Code, to read:

8042.
 The Secretary of State shall establish uniform filing forms for a candidate to use when filing a declaration of candidacy pursuant to Section 8040 and nomination papers pursuant to Section 8041.

SECTION 1.Article 1.5 (commencing with Section 8010) is added to Chapter 1 of Part 1 of Division 8 of the Elections Code, to read:
1.5.Uniform Filing System for Candidates for State Office
8010.

(a)The Secretary of State shall establish a uniform system for a candidate to file for a state office.

(b)The uniform system shall permit a candidate for state office to file both of the following nomination documents with the Secretary of State:

(1)Declaration of candidacy pursuant to Section 8040.

(2)Nomination papers signed by signers pursuant to Section 8041.

(c)For purposes of this section, “state office” means the Governor, Lieutenant Governor, Attorney General, Insurance Commissioner, Controller, Secretary of State, Treasurer, Superintendent of Public Instruction, Member of the Legislature, and member of the State Board of Equalization.
