An act to add Article 1.2 (commencing with Section 108530) to Chapter 5 of Part 3 of Division 104 of the Health and Safety Code, relating to gas stoves.

AB 2513, as amended, Pellerin. Gas stoves and ranges: warning label.
Existing law sets forth various health and safety requirements and prohibitions, including product safety label requirements.
This bill would prohibit a person from selling, attempting to sell, or offering to sell to a consumer in this state a gas stove, as defined, that is manufactured or sold online on or after January 1, 2025, or sold in a store on or after January 1, 2026, unless the gas stove bears a label label attached in a conspicuous location and, for online sales, unless the internet website prominently posts a warning, that sets forth a specified statement relating to air pollutants that can be released by gas stoves and that is attached to the gas stove in a conspicuous location, stoves, among other requirements.

The people of the State of California do enact as follows:


SECTION 1.

 Article 1.2 (commencing with Section 108530) is added to Chapter 5 of Part 3 of Division 104 of the Health and Safety Code, to read:
Article  1.2. Gas Stoves and Ranges: Warning Label

 For purposes of this chapter, a “gas the following terms apply:
(a) “Gas stove” means a household natural gas stove or range that is used for food preparation and provides at least one of the following functions:

(a)

(1) Surface cooking.

(b)

(2) Oven cooking.

(c)

(3) Broiling.
(b) “QR code” means a machine-readable code consisting of an array of squares used for storing an internet website address.

 (a) (1) A person shall not sell, attempt to sell, or offer to sell to a consumer in this state a gas stove that is manufactured or sold online on or after January 1, 2025, or sold in a store on or after January 1, 2026, unless a label on the gas stove bears the following statement:

WARNING: A gas stove or oven range in use can release nitrogen dioxide, carbon monoxide, and benzene inside homes at rates that lead to concentrations exceeding the standards of the Office of Environmental Health Hazard Assessment and the United States Environmental Protection Agency for outdoor air quality. Breathing these pollutants can exacerbate preexisting respiratory illnesses and increase the risk of developing leukemia and asthma, especially in children. To help reduce the risk of breathing harmful gases, allow ventilation in the area and turn on a vent hood when gas-powered stoves and ranges are in use.

(2) The label described in paragraph (1) shall include a QR code link to the internet website address: https://ww2.arb.ca.gov/resources/documents/indoor-air-pollution-cooking.

(b) The label described in subdivision (a) shall be attached to the gas stove in a conspicuous location. The label shall be in a type size and font no smaller than the largest type size and font used for other consumer information on the product.
(c) Before transacting an online sale of a gas stove to an address in this state, the internet website where the online sale occurs shall prominently post for the prospective purchaser the content of the warning label described in subdivision (a).
