   An act to add  Chapter 20 (commencing with Section 11900) to
Part 7 of Division 1 of Title 1 of, and to add  Article 8
(commencing with Section 60130) to Chapter 1 of Part 33 of Division 4
of Title 2  of   of,  the Education Code,
relating to school finance.



	LEGISLATIVE COUNSEL'S DIGEST


   AB 2319, as amended, Bonilla. School finance:  Broadband
Infrastructure Fund:  Innovation, Training, and Common Core
Implementation Fund. 
   (1) Existing law establishes the K-12 High-Speed Network for the
purpose of enriching pupil educational experiences and improving
pupil academic performance by providing high-speed, high-bandwidth
Internet connectivity to the public schools.  
   This bill would establish the Broadband Infrastructure Fund
Program, to be implemented if funds are received in the annual Budget
Act or another statute, for the purpose of providing schools with
adequate Internet capacity to support new content standards and
technology-based instruction and assessments, as specified. The bill
would require the State Department of Education to administer the
Broadband Infrastructure Fund, which would be established by the
bill. The bill would require the department to consider specified
objectives in evaluating any proposed use of the funds, and would
specify the purposes for which the funds may be allocated and used.
 
   Existing 
    (2)     Existing  law requires the
Academic Content Standards Commission to develop, and the State Board
of Education to adopt or reject, academic content standards in
language arts and mathematics that are internationally benchmarked
and built toward college and career readiness by high school
graduation, and requires at least 85% of these standards to be the
common core academic content standards developed by the Common Core
State Standards Initiative consortium or any association or related
interstate collaboration, except as specified.
   This bill would establish the Innovation, Training, and Common
Core Implementation Fund Act, to be implemented if funds are received
in the annual Budget Act or another statute, as specified. The bill
would require the Superintendent of Public Instruction to allocate
funds for the 2014-15 fiscal year to local educational agencies, as
defined, on the basis of an equal amount per pupil based on the prior
year's enrollment for specified purposes relating to the integration
of common core academic content standards  , Next Generation
Science Standards, and English language development standards 
in schools, including, among others, the professional development of
teachers, administrators, and paraprofessional  educators.
  educators or other classified employees involved in
the direct instruction of pupils that is aligned to specified
academic content standards.  The bill would require a local
educational agency that receives funds to meet specified
requirements, including reporting detailed expenditure information to
the State Department of Education, and would require the department
to summarize and submit the information to the appropriate budget
subcommittees and policy committees of the Legislature on or before
July 3, 2016.
   Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Chapter 20 (commencing with Section
11900) is added to Part 7 of Division 1 of Title 1 of the  
Education Code   , to read:  
      CHAPTER 20.  BROADBAND INFRASTRUCTURE FUND PROGRAM


   11900.  For purposes of assisting local educational agencies in
providing schools with adequate Internet capacity to support new
content standards, the California Assessment of Student Performance
and Progress, and technology-based instruction for the purposes of
improving the academic performance of pupils, there is hereby
established the Broadband Infrastructure Fund.
   11901.  (a) The Broadband Infrastructure Fund is established to
achieve the following objectives:
   (1) To provide all local educational agencies with the minimum
level of broadband connectivity to support the implementation of the
common core academic content standards, Next Generation Science
Standards, English language development standards, and the California
Assessment of Student Performance and Progress.
   (2) To improve academic achievement through the integration of
technology-based instruction in schools.
   (3) To ensure access for local educational agencies located in
hard-to-serve areas of the state.
   (4) To encourage collaboration between local educational agencies,
postsecondary educational institutions, and other cultural and
educational research institutions for the purpose of leveraging
regional resources.
   (5) To leverage existing statewide broadband infrastructure, such
as the K-12 High-Speed Network and the California Research and
Education Network, and other state, federal, and private funding
sources.
   (6) To fund local educational agencies with planned last mile
fiber or other projects to increase Internet capacity that lack
requisite funding to complete installation.
   (7) To establish fiber-based broadband solutions that will allow
local educational agencies to continue expanding Internet capacity
with minimal investments in the future.
   (b) The department shall consider the objectives specified in this
section when evaluating any proposed use of the funds.
   11902.  The department shall allocate funds received pursuant to
this chapter to any of the following:
   (a) Schoolsites that lack the minimum levels of broadband
connectivity to support the implementation of the common core
academic content standards, Next Generation Science Standards,
English language development standards, and the California Assessment
of Student Performance and Progress.
   (b) Schools located in hard-to-serve areas or where competitive
fiber-based broadband options are limited or not available.
   (c) Local educational agencies with planned last mile fiber or
other projects to increase Internet capacity that lack requisite
funding to complete installation.
   11903.  For purposes of this chapter, "local educational agency"
means a school district, county office of education, charter school,
or state special school.
   11904.  This chapter shall not be implemented unless funding is
provided for the Broadband Infrastructure Fund in the annual Budget
Act or another statute. 
   SECTION 1.   SEC. 2.   Article 8
(commencing with Section 60130) is added to Chapter 1 of Part 33 of
Division 4 of Title 2 of the Education Code, to read:

      Article 8.  Innovation, Training, and Common Core
Implementation Fund


   60130.  This article shall be known, and may be cited, as the
Innovation, Training, and Common Core Implementation Fund Act.
   60131.  (a) For purposes of implementing the common core academic
content standards adopted pursuant to Sections 60605.8, 60605.85, as
that section read on June 30, 2014,  60605.10, 60605.11, 
and 60811.3, as that section read on June 30, 2013, there is hereby
established the Innovation, Training, and Common Core Implementation
Fund. It is the intent of the Legislature that local educational
agencies use funds allocated pursuant to subdivision (b) to support
the integration of common core academic content  standards, Next
Generation Science Standards, and English language development 
standards in instruction for kindergarten and grades 1 to 12,
inclusive, for purposes of establishing quality instructional
programs for all pupils.
   (b) For the 2014-15 fiscal year, subject to subdivision (d), the
Superintendent shall allocate funds to local educational agencies on
the basis of an equal amount per pupil based on the prior year's
enrollment. The allocated funds shall be available for encumbrance
through the 2015-16 fiscal year.
   (c) A local educational agency shall expend funds allocated
pursuant to this section for any of the following purposes:
   (1) Professional development for teachers, administrators, and
paraprofessional educators or other classified employees involved
in the direct instruction of pupils  that is aligned to the
 common core  academic content standards adopted as
specified in subdivision (a).
   (2) Integration of the common core academic content 
standards, Next Generation Science Standards, and English language
development  standards through technology-based instruction for
purposes of improving the academic performance of pupils, including,
but not limited to, administering computer-based assessments.

   (3) Infrastructure upgrades to increase Internet bandwidth.
 
   (4) 
    (3)  Instructional materials aligned to the common core
academic content  standards, Next Generation Science Standards,
and English language development  standards adopted pursuant to
Sections 60605.8, 60605.85, as that section read on June 30, 2014,
 60605.11,  and 60811.3, as that section read on June 30,
2013, including, but not limited to, supplemental instructional
materials as provided in Sections 60605.86, 60605.87, and 60605.88,
as those sections read on June 30, 2014.
   (d) As a condition of receiving funds allocated pursuant to this
section, the governing board or body of the local educational agency
shall do both of the following:
   (1) Develop and adopt a plan delineating how funds allocated
pursuant to this section shall be spent. The plan shall be explained
in a regularly scheduled public meeting of the governing board or
body of the local educational agency before its adoption in a
subsequent regularly scheduled public meeting.
   (2) On or before January 1, 2016, report detailed expenditure
information to the department, including, but not limited to,
specific purchases made and the number of teachers, administrators,
or paraprofessional educators that received professional development.
The department shall determine the format for this report.
   (e) The department shall summarize the information reported
pursuant to paragraph (2) of subdivision (d) and shall submit the
summary to the appropriate budget subcommittees and policy committees
of the Legislature on or before July 3, 2016.
   (f) The requirement for submitting a report imposed under
subdivision (e) is inoperative on January 1, 2019, pursuant to
Section 10231.5 of the Government Code.
   60132.  For purposes of this article, "local educational agency"
means a school district, county office of education,  or
 charter  school.   school, or state
special school. 
   60133.  This article shall not be implemented unless funding is
provided for the Innovation, Training, and Common Core Implementation
Fund in the annual Budget Act or another statute.
