An act to add Section 97 to the Education Code, relating to special education.


LEGISLATIVE COUNSEL'S DIGEST


AB 2173, Addis. Special education: emotional disability.
Existing federal law defines the term “emotional disturbance” for purposes of the federal Individuals with Disabilities Education Act. Existing state law uses the term “emotional disturbance” for certain purposes relating to the provision of special education services.
This bill would provide that the term “emotional disturbance” as described above may also be known as “emotional disability” under state law.

The people of the State of California do enact as follows:


SECTION 1.

 Section 97 is added to the Education Code, immediately following Section 96, to read:

97.
 The term “emotional disturbance,” as defined in Section 300.8(c)(4) of Title 34 of the Code of Federal Regulations, and used throughout this code and the California Code of Regulations, as that term relates to the provision of special education services, may also be known as “emotional disability” under state law.
