An act to add and repeal Chapter 17 (commencing with
Section 67420) of Part 40 of Division 5 of Title 3 of the Education
Code, relating to public postsecondary education.

LEGISLATIVE COUNSEL'S DIGEST
AB 2168, as amended, Campos. Public postsecondary
education: California College Campus Discrimination and Violence
Prevention Task Force. School employees: San Jose
Unified School District.
Existing law establishes a system of public elementary and
secondary schools in this state pursuant to which school districts
operate schools and employ certificated personnel to provide
instruction to pupils. Existing law establishes procedures for the
hiring of these employees, and authorizes school districts to
negotiate, and enter into, collective bargaining agreements with
entities representing employees.
This bill would declare that the San Jose Unified School District
was, and is, authorized to enter into, and execute the provisions of,
a specified collective bargaining agreement between that district
and the San Jose Teachers Association.
This bill would make a legislative finding and declaration as to
the necessity of a special statute applicable to the San Jose Unified
School District.
Existing law establishes the segments of the postsecondary
education system in the state, including the University of California
administered by the Regents of the University of California, the
California State University administered by the Trustees of the
California State University, the California Community Colleges
administered by the Board of Governors of the California Community
Colleges, and the independent institutions of higher education in
this state.
This bill would establish the California College Campus
Discrimination and Violence Prevention Task Force consisting of 13
members appointed by the Governor, the Speaker of the Senate
Committee on Rules, and the Speaker of the Assembly, as specified.
The task force would also consist of a representative of the
Chancellor of the California State University appointed by the
trustees, the Chancellor of the California Community Colleges
appointed by the board of governors, the organization that represents
the largest number, as of January 1, 2015, of independent
institutions of higher education, as defined, to be appointed by the
organization, and requests a representative of the Office of the
President of the University of California to be appointed by the
regents. The bill would require the task force to examine and make
recommendations to the Governor and the Legislature, on or before
January 1, 2016, on steps that can be taken to reduce incidents of
discrimination, hate crime, and campus violence on the campuses of
the University of California, the California State University, the
California Community Colleges, and independent institution of higher
education. The bill would repeal these provisions on March 1, 2016.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Notwithstanding Section 44929.21 of the
Education Code or any other law, the San Jose Unified School
District was, and is, authorized to enter into, and execute the
provisions of, the collective bargaining agreement between that
district and the San Jose Teachers Association for the term of July
1, 2013, to June 30, 2016, inclusive, which was ratified by the
governing board of the San Jose Unified School District on May 23,
2013.
SEC. 2. The Legislature finds and declares that a
special law is necessary and that a general law cannot be made
applicable within the meaning of Section 16 of Article IV of the
California Constitution because of the unique labor relations
situation in the San Jose Unified School District stemming from the
collective bargaining agreement entered into between that district
and the San Jose Teachers Association in 2013. The enactment of
Section 1 of this act as a special law applicable to the San Jose
Unified School District is therefore necessary.
SECTION 1. Chapter 17 (commencing with Section
67420) is added to Part 40 of Division 5 of Title 3 of the Education
Code, to read:
CHAPTER 17. CALIFORNIA COLLEGE CAMPUS DISCRIMINATION AND
VIOLENCE PREVENTION TASK FORCE
67420. (a) The California College Campus Discrimination and
Violence Prevention Task Force is hereby established in state
government.
(b) The task force shall consist of 13 members who reflect the
ethnic and gender diversity of California. These members shall be
appointed as follows:
(1) Seven members appointed by the Governor.
(2) Three members appointed by the Senate Committee on Rules.
(3) Three members appointed by the Speaker of the Assembly.
(c) The task force shall consist of three additional members
appointed as follows:
(1) One representative of the Office of the Chancellor of the
California State University to be appointed by the Trustees of the
California State University.
(2) One representative of the Office of the Chancellor of the
California Community Colleges to be appointed by the Board of
Governors of the California Community Colleges.
(3) One representative of the organization that represents the
largest number, as of January 1, 2015, of independent institutions of
higher education in California, as defined pursuant to Section
66010. The organization shall appoint this representative.
(d) The Legislature requests the Regents of the University of
California to appoint a representative of the Office of the President
of the University of California to be an additional member of the
task force.
67421. The California College Campus Discrimination and Violence
Prevention Task Force shall examine and make recommendations to the
Governor and the appropriate committees of the Legislature, on or
before January 1, 2016, on steps that can be taken to reduce
incidents of discrimination, hate crime, and campus violence on the
campuses of the University of California, the California State
University, the California Community Colleges, and independent
institutions of higher education in this state.
67422. This chapter shall remain in effect only until January 1,
2017, and as of that date is repealed, unless a later enacted
statute, that is enacted before January 1, 2017, deletes or extends
that date.
