CALIFORNIA LEGISLATURE— 2023–2024 REGULAR SESSION

Assembly Bill
No. 2025

Introduced by Assembly Member Bennett

February 01, 2024

An act to amend Section 30522 of the Public Resources Code, relating to coastal resources.

LEGISLATIVE COUNSEL'S DIGEST

AB 2025, as introduced, Bennett. Coastal resources: certification of local coastal programs.
The California Coastal Act of 1976 establishes the California Coastal Commission, and prescribes procedures for the preparation, approval, and certification of local coastal programs that regulate development in the coastal zone, as defined, in jurisdictions that have a certified local coastal program. The act specifies that it does not permit the commission to certify a local coastal program that provides for a lesser degree of environmental protection than that provided by the plans and policies of any state regulatory agency that are formally adopted by that agency, are used in the regulatory program of that agency, and are legally enforceable.
This bill would make nonsubstantive changes in that latter provision.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: NO   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 30522 of the Public Resources Code is amended to read:

30522.
Nothing in this chapter shall permit the commission to certify a local coastal program which that provides for a lesser degree of environmental protection than that provided by the plans and policies of any state regulatory agency that are formally adopted by such that agency, are used in the regulatory program of such that agency, and are legally enforceable.
