This bill instead would require the governing board of a school district to employ substitute employees of the school district as the governing board of the school district deems necessary. The bill would also make nonsubstantive changes. To the extent this bill would require additional duties on school districts regarding the employment of substitute teachers, the bill would impose a state-mandated local program.
The
California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:
SECTION 1.
(a) For the 2022–23 fiscal year, the sum of one hundred million dollars ($100,000,000) is hereby appropriated to the State Department of Education to establish and administer the Substitute Teacher Support Grant Program. Under the program, one-time competitive grants shall be provided to local educational agencies to develop and implement new, or expand existing, locally identified solutions that address local substitute teacher shortages or needs for professional development for substitute teachers. The Superintendent of Public Instruction shall apportion program funds to a local educational agency to professionalize its substitute teacher pool by providing professional development for substitute teachers or implementing innovative strategies to expand its substitute teacher pool. This funding shall be available for encumbrance through June 30, 2028.(a)The governing board of a school district shall employ substitute employees of the
school district as the governing board of the school district deems necessary and shall adopt and make public a salary schedule setting the daily or pay period rate or rates for substitute employees.
(b)This section shall not be construed as modifying or repealing any law fixing a minimum annual salary for employees of
the school district.
If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
