An act to amend Section 39605 of the Health and Safety Code, relating to air resources. An act to add Section 44272.8 to the Health and Safety Code, relating to vehicular air pollution.

Existing law establishes the California Alternative and Renewable Fuel, Vehicle Technology, Clean Air, and Carbon Reduction Act of 2007, which includes the Alternative and Renewable Fuel and Vehicle Technology Program, administered by the State Energy Resources Conservation and Development Commission.
Existing law requires the commission, as part of the Alternative and Renewable Fuel and Vehicle Technology Program, to provide funding measures to certain entities to develop and deploy innovative technologies that transform California’s fuel and vehicle types to help attain the state’s climate change policies. Existing law requires the commission to give preference to those projects that maximize the goals of the program based on specified criteria.
This bill would require the commission, for the moneys available for allocation as part of the program, to allocate no less than 20% for biofuels production and infrastructure and no less than 25% for alternative fuel vehicle incentives.

Existing law regulates the emissions of air pollution and authorizes the State Air Resources Board to take certain actions, including the provision of assistance to a local air quality management or air pollution control district.

This bill would make nonsubstantive changes to that provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 44272.8 is added to the Health and Safety Code, to read:

44272.8.
 For the moneys available for allocation pursuant to this article, the commission shall do both of the following:
(a) No less than 20 percent shall be allocated for biofuels production and infrastructure.
(b) No less than 25 percent shall be allocated for alternative fuel vehicle incentives.

SECTION 1.Section 39605 of the Health and Safety Code is amended to read:
39605.

To carry out the purposes of this division, the state board may do any of the following:

(a) Provide assistance to a district.

(b) Require a district to provide requested information utilized in the normal operation of the district or required by a state or federal statute or regulation.

(c) Hold public hearings.

(d) Accept assistance, financial and otherwise, from a public entity.
