An act to add Section 716 to the Military and Veterans Code, relating to veterans.

Veterans: security clearances.
Existing law establishes the Department of Veterans Affairs, which, among other things, is required to aid veterans in accessing benefits. Existing law requires the department to develop a transition assistance program for veterans who have been discharged from the Armed Forces of the United States or the National Guard of any state, including higher education benefits and program information, vocational training assistance, and small business resources and information. Existing law requires a state agency to rank a veteran, widow or widower of a veteran, or spouse of a 100% disabled veteran in the top rank of an eligibility list for hiring when the person achieves a passing score on the examination.
Existing law authorizes various state entities to require fingerprint images and associated information from a prospective employee whose duties
would include access to confidential information and cash, among other things. Existing law generally requires a state entity that is required to conduct criminal background checks to comply with applicable federal requirements.
This bill would require the department to collaborate with state agencies and departments, including public colleges and universities, specified state entities to establish a veterans’ preference to be applied to employment opportunities within the field of cybersecurity that require a security clearance. The bill would require a state agency or department agency, as defined,
that hires for a position in cybersecurity that requires a security clearance to apply the veterans’ preference and to establish a uniform hiring policy for veterans who have recently held a security clearance. clearance in the last year and have left the military in good standing or were honorably discharged.

The people of the State of California do enact as follows:
SECTION 1.
Section 716 is added to the Military and Veterans Code, to read:716.
(a) It is the intent of the Legislature to authorize state departments and agencies that require security clearances to recognize the clearances held by veterans transitioning from the military in order to remove barriers to employment and accelerate transition to civilian employment within cybersecurity.(b) The department shall collaborate with state agencies and departments, including public colleges and universities, the Department of Human Resources, the Office of Emergency Services, the Department of Technology, the Department of
the California Highway Patrol, and the Military Department to establish a veterans’ preference to be applied to employment opportunities within the field of cybersecurity that require a security clearance.
(c) A state agency or department agency, including a public college or university, that hires for a position in cybersecurity that requires a security clearance shall apply the veterans’ preference established in subdivision (b) and shall establish a uniform hiring policy for veterans who have recently held a security clearance.
