An act to add Section 49065.5 to the Education Code, relating to pupils.

AB 1329, as amended, Nazarian. Pupils: demographic data.
Existing law requires the Commission on Teacher Credentialing, the State Board of Education, and the State Department of Education to provide to the State Chief Information officer Director of Technology the individual nonpersonally identifiable or aggregate data related to, among other things, demographics of pupils and teachers.
This bill would state that it is the intent of the Legislature to enact legislation that would promote the accurate collection of demographic data pertaining to pupils. require the governing board or body of a school district or charter school to collect information on each pupil’s race and ethnicity and to disaggregate that data, as specified. The bill would require that information to be used for state reporting purposes only.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 49065.5 is added to the Education Code, to read:

49065.5.
 The governing board or body of a school district or charter school shall collect information on each pupil’s race and ethnicity and shall disaggregate that data in a manner that better reflects the diversity of the pupil population. The information collected pursuant to this section shall be used for state reporting purposes only.

SEC. 2.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
SECTION 1.

It is the intent of the Legislature to enact legislation that would promote the accurate collection of demographic data pertaining to pupils.
