An act to add Article 6 (commencing with Section 108670) to Chapter 5 of Part 3 of Division 104 of the Health and Safety Code, relating to marijuana. consumer product safety.


LEGISLATIVE COUNSEL'S DIGEST


AB 1244, as amended, Voepel. Marijuana: production of concentrated cannabis. Consumer product safety: butane gas.
Existing law prohibits the distribution or sale of certain products, or products containing certain chemicals which are hazardous to the health or safety of consumers.
This bill would prohibit the distribution or sale of any butane gas or product containing butane gas which does not have an odorant added.

Existing law does not prohibit a person 21 years of age or older from possessing marijuana or marijuana products, including concentrated cannabis. Existing law requires the State Department of Public Health to regulate persons that conduct the production of marijuana products, including the use of volatile chemical solvents for the extraction of concentrated cannabis.

This bill would express the intent of the Legislature to enact legislation relating to the production of concentrated cannabis using butane.

The people of the State of California do enact as follows:


SECTION 1.

 Article 6 (commencing with Section 108670) is added to Chapter 5 of Part 3 of Division 104 of the Health and Safety Code, to read:
Article  6. Butane Gas

 (a) No person shall distribute, sell, exchange, expose for sale, or offer for sale within the state any butane gas or product containing butane gas which does not have an odorant added.
(b) As used in this section, “odorant” means a chemical with a distinctive odor which is added to a gas for the purpose of providing a warning of the presence of the gas.

SECTION 1.

It is the intent of the Legislature to enact legislation relating to the use of butane in the production of concentrated cannabis.
