(2)Existing law authorizes the coordinating council to establish working groups, task forces, or other structures from within its membership or with outside members to assist it in its work. The Bagley-Keene Open Meeting Act requires, with specified exceptions for authorized closed sessions, that all meetings of a state body be open and public and all persons be permitted to attend any meeting of a
state body.
The bill would provide that the Bagley-Keene Open Meeting Act does not apply to a meeting of a working group, task force, or other structure of the California Interagency Council on Homelessness if only a minority of the members of the council participate in that working group, task force, or other structure. The bill would specify that, except under those circumstances, the council and its meetings are subject to the act.
(3)Existing constitutional provisions require that a statute that limits the right of access to the meetings of public bodies or the writings of public officials and agencies be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest.
This bill would make legislative findings to that effect.

The people of the State of California do enact as follows:
SECTION 1.
Section 50210 of the Health and Safety Code is amended to read:50210.
For purposes of this chapter, the following definitions shall apply:SEC. 2.
Section 50216 of the Health and Safety Code is amended to read:50216.
For purposes of this chapter:SEC. 3.
Section 8255 of the Welfare and Institutions Code is amended to read:8255.
For purposes of this chapter:SEC. 4.
Section 8256 of the Welfare and Institutions Code is amended to read:8256.
(a) Agencies and departments administering state programs created on or after July 1, 2017, shall collaborate with the California Interagency Council on Homelessness to adopt guidelines and regulations to incorporate core components of Housing First.SEC. 5.
Section 8257 of the Welfare and Institutions Code is amended to read:8257.
(a) The Governor shall create an Interagency Council on Homelessness.(1)The Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code) shall not apply to a meeting of a working group, task force, or other structure within the membership if only a minority of members of the council participate in that working group, task force, or other structure.
(2)Except as provided in paragraph (1),
the council is subject to the Bagley-Keene Open Meeting Act and all meetings of the council are subject to the Bagley-Keene Open Meeting Act.
SEC. 6.
Section 8260 of the Welfare and Institutions Code is amended to read:8260.
The following definitions apply for purposes of this chapter:The Legislature finds and declares that Section 5 of this act, which amends Section 8257 of the Welfare and Institutions Code, imposes a limitation on the public’s right of access to the meetings of public bodies or the writings of public officials and agencies within the meaning of Section 3 of Article I of the California Constitution. Pursuant to that constitutional provision, the Legislature makes the following findings to demonstrate the interest protected by this limitation and the need for protecting that interest:
The limitations on the people’s right of access set forth in this act are necessary to allow for the free flow of information
and ideas during conversations occurring in meetings of a minority number of members of the California Interagency Council on Homelessness.
