   An act to amend Section 8902 of the Government Code, relating to
state officers.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1012, as introduced, Cook. State officers.
   Existing law authorizes the California Victim Compensation and
Government Claims Board to adopt regulations governing any matter
over which it has jurisdiction. Existing law entitles a Member of the
Legislature to reimbursement of living expenses when in Sacramento
to attend a session of the Legislature or when attending to other
specified legislative duties, at a rate established by the board, but
not less than the rate provided to federal employees traveling to
Sacramento.
   This bill would provide that there shall be no reimbursement for
the living expenses of a late or absent Member of the Legislature.
   The California Constitution requires a 2/3 vote for a measure that
prescribes reimbursement of living expenses in connection with the
official duties of a Member of the Legislature.
   This bill would therefore require a 2/3 vote.
   Vote: 2/3. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 8902 of the Government Code is amended to read:

   8902.  During those times that a Member of the Legislature is
required to be in Sacramento to attend a session of the Legislature
and during those times that a  member   Member
 is traveling to and from, or is in attendance at, any meeting
of a committee of which he or she is a  member  
Member  or is attending to any other legislative function or
responsibility as authorized or directed by the rules of the house of
which he or she is a  member   Member  or
by the joint rules, he or she shall be entitled to reimbursement of
his or her living expenses , unless the Member is late or absent,
 at a rate established by the California Victim Compensation
and Government Claims Board that is not less than the rate provided
to federal employees traveling to Sacramento.  If a Member is
late or absent, the Member shall receive no reimbursement of his or
her living expenses for the date on which the Member is late or
absent.
