A CONCURRENT RESOLUTION

 

proposing an amendment to the Constitution of Arizona; amending article IX, section 12, constitution of Arizona; relating to taxation.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1.  Article IX, section 12, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE12.  Authority to provide for levy and collection of license and other taxes

Section 12.  A.  Except as provided by subsection B of this section, the law-making power shall have authority to provide for the levy and collection of license, franchise, gross revenue, excise, income, collateral and direct inheritance, legacy, and succession taxes, also graduated income taxes, graduated collateral and direct inheritance taxes, graduated legacy and succession taxes, stamp, registration, production, or other specific taxes.

B.  Beginning January 1, 2015, the income of individuals, corporations and other legal entities shall not be subject to taxation by this state or by any county, city, town or other political subdivision of this state.  The legislature shall provide for annual reductions in the rates of individual and corporate income taxes in order to eliminate income taxation before January 1, 2015.  The legislature may enact increases in the rates of transaction privilege taxation on business classifications in effect on January 1, 2010, to compensate for income tax revenue reduction under this subsection, and other conforming statutory provisions, and those enactments are exempt from the requirements of section 22 of this article if they are merely compensatory and do not provide for a net increase in state revenues. 2.  This measure shall be referred to as the "Arizona Fair Tax".

3.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
