AN ACT
amending Title 15, chapter 2, article 2, Arizona Revised Statutes, by adding section 15-249.02; relating to the department of education.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 15-249.02, to read:
15-249.02. Teacher liability insurance; request for proposals; contract
The department of education shall issue a request for proposals to insurance carriers to provide statewide personal liability insurance to teachers employed by school districts to cover conduct that falls outside of a teacher's scope of employment and which is not already covered by the district's existing insurance coverage. The liability insurance contemplated by this section is an alternative to the personal liability insurance provided pursuant to section 15‑502, subsection G. On or before December 31, 2011, the department of education shall award a contract to the insurance carrier that will provide teacher liability insurance in the most efficient and cost-effective manner. Any teacher employed by a school district may authorize the school district pursuant to section 23‑352 to withhold a portion of the teacher's wages for the purpose of purchasing liability insurance from the insurance carrier selected by the department pursuant to this section.
