AN ACT

 

Amending section 13-3603, Arizona Revised Statutes; relating to family offenses.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 13-3603, Arizona Revised Statutes, is amended to read:

START_STATUTE13-3603. Abortion; violation; classification

A. A person who provides, supplies or administers to a pregnant woman, or procures such woman to take any medicine, drugs or substance, or uses or employs any instrument or other means whatever, with intent thereby to procure the miscarriage of such woman, unless it is necessary to save her life, shall be punished by imprisonment in the state prison for not less than two years nor more than five years is guilty of a class 3 felony.

B. A person who is convicted of a violation of subsection A of this section is not eligible for suspension of sentence, probation, pardon or release from confinement on any basis except pursuant to section 31-233, subsection A or B until the sentence imposed by the court has been served or the sentence is commuted.
