SENATE BILL 1443

 

 

AN ACT

 

PRoviding state land transfer to Bullhead City in public trust for public recreation and access to the Colorado River.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Land transfer; conditions on use; fee; reversion

A.  The state sovereign land described in subsections B and C of this section is transferred from this state to the City of Bullhead City on the effective date of this act.

B.  The state sovereign land referred to in subsection A of this section is described as follows:

A portion of section 30, township 21 North, range 21 West of the Gila and Salt River meridian, Mohave County, Arizona described as follows:

Commencing at the witness corner between said sections 30 and 31 being a 1/2" rebar with the local coordinates of North 1517427.855', East 455811.101'; thence South 89° 57' 21" West, 70.95 feet along the westerly extension of the line between said sections 30 and 31 to a point on the determined avulsion line along the East bank of the Colorado River; thence the following courses and distances along said avulsion line: thence North 0O° 59' 52" West for 141.16 feet; thence North O9° 22' 40" West for 69.94 feet; thence North 15° 16' 51" West for 149.16 feet; thence North 07° 49' 39" West for 71.04 feet; thence North 13° 38' 28" West for 69.17 feet; thence North 21° 46' 23" West for 57.96 feet; thence North 09° 22' 55" West for 65.60 feet; thence North 25° 42' 25" West for 60.18 feet; thence North 42° 07' 42" West for 151.35 feet to a point on the ordinary high water mark being the point of beginning; thence North 06° 40' 23" East for 46.37 feet; thence North 00° 56' 29" East for 45.87 feet; thence North 07° 54' 17" West for 47.93 feet; thence North 05° 52' 57" West for 35.57 feet; thence North 07° 27' 20" East for 39.89 feet; thence North 02° 22' 33" East for 42.40 feet; thence North 02° 00' 29" East for 33.53 feet; thence North 08° 24' 25" West for 17.89 feet; thence North 16° 42' 09" East for 40.07 feet; thence North 01° 10' 03" West for 38.90 feet; thence North 26° 13' 32" East for 42.97 feet; thence North 01° 21' 07" East for 38.74 feet; thence North 18° 20' 43" East for 14.83 feet; thence North 30° 38' 42" East for 26.26 feet; thence North 84° 51' 51" West for 27.44 feet; thence North 26° 38' 18" West for 25.99 feet; thence leaving said ordinary high water mark North 89° 20' 26" West for 365.27 feet to the centerline of the Colorado River; thence the following courses and distances along said centerline: thence South 10° 36' 09" East for 27.91 feet; thence South 79° 43' 26" East for 13.77 feet; thence South 18° 57' 32" West for 23.89 feet; thence South 01° 11' 11" West for 14.08 feet; thence South 02° 33' 31" West for 38.77 feet; thence South 13° 36' 49" West for 39.67 feet; thence South 05° 56' 06" East for 39.10 feet; thence South 06° 39' 57" West for 38.64 feet; thence South 03° 19' 54" East for 17.73 feet; thence South 03° 34' 48" West for 33.57 feet; thence South 02° 55' 53" West for 42.42 feet; thence South 05° 12' 45" West for 39.72 feet; thence South 03° 37' 49" East for 35.45 feet; thence South 05° 52' 49" East for 47.73 feet; thence South 04° 15' 42" West for 45.99 feet; thence South 07° 51' 00" West for 46.49 feet; thence leaving said centerline North 90° 00' 00" East for 364.50 feet to the point of beginning.

The above parcel of land contains 4.408 acres more or less.

C.  In addition to subsection B of this section, the state sovereign land referred to in subsection A of this section is described as follows:

A portion of section 30, township 21 North, range 21 West of the Gila and Salt River meridian, Mohave County, Arizona described as follows:

Commencing at the witness corner between said sections 30 and 31 being a 1/2" rebar with the local coordinates of North 1517427.855', East 455811.101'; thence South 89° 57' 21" West, 70.95 feet along the westerly extension of the line between said sections 30 and 31 to a point on the determined avulsion line along the East bank of the Colorado River said point being the point of beginning; thence the following courses and distances along said avulsion line: thence North 00° 59' 50" West for 141.16 feet; thence North 09° 22' 41" West for 69.94 feet; thence North l5° 16' 51" West for 149.16 feet; thence North 07° 49' 40" West for 71.04 feet; thence North 13° 38' 28" West for 69.17 feet; thence North 21° 46' 22" West for 57.97 feet; thence North 09° 22' 54" West for 65.60 feet; thence North 25° 42' 26" West for 60.18 feet; thence North 42° 07' 42" West for 151.35 feet; thence leaving said avulsion line North 90° 00' 00" West for 364.50 feet to the centerline of the Colorado River; thence the following courses and distances along said centerline: thence South 31° 14' 17" East for 108.59 feet; thence South 14° 40' 15" East for 47.48 feet; thence South 03° 09' 40" East for 64.36 feet; thence South 09° 49' 09" East for 53.81 feet; thence South 05° 17' 52" East for 66.84 feet; thence South 03° 20' 04" East for 70.13 feet; thence South 07° 43' 33" East for 133.38 feet; thence South 02° 01' 52" East for 68.27 feet; thence South 01° 31' 46" East for 129.91 feet; thence South 04° 24' 28" East for 54.30 feet; thence North 89° 57' 21" East for 484.17 feet to the point of beginning.

The above described parcel of land contains 7.97 acres more or less.

D.  Within ten days after the effective date of this act, the state land commissioner shall deliver to the City of Bullhead City a properly signed and recorded deed or patent that contains the conditions on use of the transferred land as provided by this section.

E.  The land transferred pursuant to this section shall be held and managed exclusively for public trust purposes, in this case public recreation and access to and enjoyment of the Colorado River, and may not be sold, exchanged or bartered.

F.  The City of Bullhead City may charge a reasonable fee for costs of managing the transferred land.  Any revenue derived from the use of the transferred land shall be deposited in an account that is restricted to use for public trust purposes, including managing the transferred land.

G.  If the transferred land or any revenue derived from the use of the transferred land ceases to be held or managed exclusively for public trust purposes, the transferred land shall immediately and automatically revert to this state.  The reversion may be confirmed through properly instituted judicial proceedings in a court of general jurisdiction in this state.
