AN ACT

 

amending title 41, chapter 6, article 7.2, Arizona Revised Statutes, by adding section 41‑1080.01; relating to licensing eligibility.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Heading change

The article heading of title 41, chapter 6, article 7.2, Arizona Revised Statutes, is changed from "LICENSING ELIGIBILITY" to "LICENSING ELIGIBILITY AND MORATORIUM".

Sec. 2.  Title 41, chapter 6, article 7.2, Arizona Revised Statutes, is amended by adding section 41-1080.01, to read:

START_STATUTE41-1080.01. Home-based business; licensing moratorium during a certain level of unemployment; definitions

A.  if the seasonally adjusted unemployment rate, as published by the office of employment and population statistics, reaches at least ten percent for this state, an agency may not require a home‑based business to have a valid license.  once the seasonally adjusted unemployment rate, as published by the office of employment and population statistics, reaches less than six percent for this state, an agency may resume requiring a home‑based business to have a valid license as prescribed by law.

B.  For the purposes of this section:

1.  "Agency" means any agency, department, board or commission of this state or of any political subdivision of this state that issues a license for the purpose of operating a business in this state or to an individual who provides a service to any person.

2.  "License" means any permit, certificate, approval, registration, charter or similar form of authorization that is required by law and that is issued by any agency for the purpose of operating a business in this state or to an individual who provides a service to any person and the license is required to perform that service.END STATUTE
