AN ACT

 

amending Title 41, chapter 6.1, article 1, Arizona Revised Statutes, by adding section 41-1096; relating to rulemaking review.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 6.1, article 1, Arizona Revised Statutes, is amended by adding section 41-1096, to read:

START_STATUTE41-1096.  Legislative review of rules

A.  Any standing committee of the legislature may review any proposed, final, expedited or emergency rule.  If a rule is reviewed, the standing committee that reviewed the rule shall report to the membership of the body the standing committee's findings and recommendations concerning the review of the rule.  If ordered by the presiding officer, the report of the standing committee shall be printed in the legislative journal. 

B.  A concurrent resolution may be adopted approving or rejecting a proposed, final, expedited or emergency rule if the standing committee determines that the rule violates the legislative intent of the statute under which the rule was adopted.  If a rule is rejected by concurrent resolution, the rule is rendered void and unenforceable. If the legislature adopts a concurrent resolution approving or rejecting a rule, the secretary of state shall immediately notify the affected agency of the filing and effective date of the concurrent resolution and shall transmit a copy of the concurrent resolution to the director of the affected agency.  If a rule is rejected by concurrent resolution, the affected agency shall implement the legislative intent as expressed in the concurrent resolution, including, as appropriate, reinstating the prior rule, and shall publish notice of the rejected rule in the Arizona administrative register.

C.  Every rule adopted in accordance with chapter 6 of this title remains in full force and effect until rejected by concurrent resolution or until the rule expires pursuant to section 41‑1056.  END_STATUTE
