SENATE BILL 1328

 

 

 

AN ACT

 

Amending Title 46, Arizona Revised Statutes, by adding chapter 8; relating to fraud prevention.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 46, Arizona Revised Statutes, is amended by adding chapter 8, to read:

CHAPTER 8

FRAUD PREVENTION

ARTICLE 1.  GENERAL PROVISIONS

START_STATUTE46-821.  Definitions

In this chapter, unless the context otherwise requires:

1.  "Department" means the department of economic security.

2.  "Identity information" means an applicant or recipient's full name, aliases, date of birth, address, social security number and other related information. END_STATUTE

START_STATUTE46-822.  Enhanced eligibility verification system

A.  Subject to the determination made pursuant to subsection C of this section, the department shall establish through a third‑party contract a computerized income, asset and identity eligibility verification system or systems in order to verify eligibility, eliminate the duplication of assistance and deter waste, fraud and abuse within the supplemental nutrition assistance program established pursuant to 7 United States Code section 2013 and cash assistance.

B.  The department shall contract with a third‑party vendor or third‑party vendors for the purposes of developing a system or systems to verify applicant income, asset and identity information to prevent fraud, misrepresentation and inadequate documentation when determining an applicant's eligibility for assistance before the distribution of benefits, periodically between eligibility redeterminations and during eligibility redeterminations and reviews.  The department may also contract with a vendor or vendors to provide information to facilitate recipient eligibility reviews conducted by the department.

C.  Before entering into a contract or contracts pursuant to subsection B of this section, the department shall conduct an evaluation of systems to establish estimates of potential savings or cost avoidance compared to the estimated costs of implementation.  If the department determines that the savings of implementing a contract or contracts exceed the costs of contracting with a third‑party vendor, the department shall enter into a contract or contracts to provide income, asset and identity verification systems. Sec. 2.  Effective date

This act is effective from and after December 31, 2015.
