AN ACT

 

amending title 44, chapter 35, article 1, Arizona Revised Statutes, by adding section 44-7807; relating to credit cards.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 35, article 1, Arizona Revised Statutes, is amended by adding section 44-7807, to read:

START_STATUTE44-7807.  Use fees for state entities; enforcement; civil penalty

a.  If an issuer does business with a state entity that acts as a merchant, any fee that the issuer charges the state entity when the issuer's credit card is used must be the issuer's lowest fee.  The state entity may require the issuer to submit a certified statement to the state entity that the fee is the issuer's lowest fee.

B.  The attorney general may enforce this section in cooperation with the state treasurer.

C.  A person who violates this section is subject to a civil penalty equal to three times the fee that the issuer charged to the state entitiy.END_STATUTE
