SENATE BILL 1210

 

 

 

AN ACT

 

amending Title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.32; relating to municipal policies.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.32, to read:

START_STATUTE9-500.32.  Personnel and purchasing policies; violation; state shared revenues

A.  If a complaint is filed with the ombudsman-citizens aide or an independent auditor alleging that a city or town has wilfully violated any of the city's or town's personnel or purchasing policies, the ombudsman-citizens aide or independent auditor shall investigate the complaint and issue a written determination.

B.  If a city or town is found to be in violation of any of its personnel or purchasing policies and fails to cure the violation, on the written determination of the ombudsman-citizens aide or independent auditor the state treasurer shall withhold at least ten per cent of the city's or town's distribution of monies that would otherwise be distributed pursuant to sections 42‑5029 and 43-206.  The state treasurer shall continue withholding subsequent distributions until the city or town complies with the personnel or purchasing policy as determined by the ombudsman‑citizens aide or the independent auditor.
