AN ACT
amending title 41, chapter 23, article 1, Arizona Revised Statutes, by adding section 41‑2505; relating to the state procurement code.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 23, article 1, Arizona Revised Statutes, is amended by adding section 41-2505, to read:
41-2505. Preference for Arizona bidders for identical bids; definition
A. For contracts awarded pursuant to section 41-2533, subsection G, if there are two or more low, responsive offers from responsible bidders, an Arizona bidder shall be given preference over a nonresident bidder by increasing the bid of a nonresident bidder by five percent.
B. The penalty for not performing at least fifty percent of the labor associated with the bid using Arizona workers who file tax returns in this state shall be a reduction in the contract price equal to the percentage of the labor required to meet the fifty percent threshold for in-state labor.
C. For the purposes of this section, "Arizona bidder" means a bidder that satisfies all of the following:
1. Is authorized to transact business in this state.
2. Maintains a physical presence in this state.
3. Pays all assessed taxes.
4. Performs at least fifty percent of the labor associated with the bid using Arizona workers who file tax returns in this state.
