AN ACT

 

amending Title 4, chapter 2, article 1, Arizona Revised Statutes, by adding section 4‑203.06; relating to SPIRITUOUS liquor regulations.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 4, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 4-203.06, to read:

START_STATUTE4-203.06.  Beer festival license; beer fair license; fee

A.  The director, subject to the approval of the board of supervisors for events to be held in an unincorporated area or the governing body of a city or town for events to be held in the city or town, may issue up to twenty-five beer festival licenses for each calendar year for each licensed domestic microbrewery, for up to a total of seventy-five calendar days per microbrewery, authorizing sampling of domestic microbrewery products on the beer festival premises, the sale of such products for consumption on the beer festival premises and the sale of such products in original containers for consumption off the beer festival premises.  The fee for a domestic microbrewery beer festival license is fifteen dollars for each event.

B.  Any domestic microbrewery may apply for a beer festival license pursuant to this section.

C.  For any sanctioned county or state fair The director, with the permission of the fair organizers, may issue to any domestic microbrewery a beer fair license authorizing sampling of domestic microbrewery products on the fair premises, the sale of such products for consumption on the fair premises and the sale of such products in original containers for consumption off of the fair premises.  The fee for a domestic microbrewery fair license is fifteen dollars for each event. Sec. 2.  Legislative dedication

The legislature dedicates this act to the memory of Christopher Wilson.

Sec. 3.  Requirements for enactment; two-thirds vote

Pursuant to article IX, section 22, Constitution of Arizona, this act is effective only on the affirmative vote of at least two-thirds of the members of each house of the legislature and is effective immediately on the signature of the governor or, if the governor vetoes this act, on the subsequent affirmative vote of at least three-fourths of the members of each house of the legislature.
