AN ACT

 

Amending title 20, chapter 5, article 1, Arizona Revised Statutes, by adding section 20‑1119.01; relating to insurance contracts.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 20, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 20-1119.01, to read:

START_STATUTE20-1119.01.  Insurance policy summaries

A.  An insurer may provide or make available to insureds a summary of policy coverages and exclusions.  If an insurer provides or makes available a policy summary, the summary shall include all of the following:

1.  A brief description of the coverages provided under the policy.

2.  A brief description of the exclusions under the policy that operate to limit or negate the coverages otherwise provided under the policy.

3.  A notice that is prominently displayed on the cover page or a page that corresponds to the cover page of the policy summary, that is in a contrasting color or bold-face type and that states:  "This policy summary is for informational purposes only and is designed to provide a basic description of insurance coverages and exclusions in your policy.  This summary does not reflect all of the coverages and exclusions contained in your policy.  The policy controls in the event of a conflict between your policy and this summary". 

B.  An insurer's election to provide or make a policy summary available to an insured does not obligate the insurer to provide a policy summary at policy renewal or for any other policies issued to the same insured.

C.  A policy summary is not a replacement for the policy, does not have the effect of altering the coverages or exclusions under the policy and does not confer new or additional rights beyond those expressly provided for in the policy. 

D.  A person engaged in the business of insurance in this state may not provide or use a policy summary that contains false, misleading or deceptive representations or statements.  A violation of this subsection is an unfair trade practice under chapter 2, article 6 of this title. 

E.  This section does not create or imply a private cause of action for a violation of this section.END_STATUTE
