HOUSE CONCURRENT RESOLUTION 2036

 

 

 

A concurrent RESOLUTION

 

Supporting an amendment to the clean air act to exempt crustal dust related to agricultural production from particulate matter standards.

Whereas, the United States Environmental Protection Agency enforces particulate matter standards pursuant to the Clean Air Act under normal weather and meteorological conditions; and

Whereas, the United States Environmental Protection Agency has the regulatory authority to exclude exceedances of particulate matter standards under a natural or exceptional event occurrence; and

Whereas, crustal organic dust, which does not have the same harmful effects as fine combusted particles on public health, easily becomes airborne during drought and dry periods; and

Whereas, Arizona is an arid environment in which the lack of rainfall alone can cause agricultural areas to exceed the particulate matter standards.

Therefore

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1. That the Members of the Legislature support an amendment to the Clean Air Act Amendments of 1990 to provide for an exclusionary exemption for coarse crustal dust derived from the normal agricultural production of feeding livestock and raising crops.

2. That the Secretary of State of the State of Arizona transmit copies of this Resolution to the President of the United States Senate, the Speaker of the United States House of Representatives, each Member of Congress from the State of Arizona and each Speaker of the House of Representatives and each President of the Senate of the other state legislatures.
