AN ACT
amending title 28, chapter 20, article 5, Arizona Revised Statutes, by adding section 28-7060; repealing section 28-7060, Arizona Revised Statutes; relating to state highways.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 28, chapter 20, article 5, Arizona Revised Statutes, is amended by adding section 28-7060, to read:
28-7060. New state highway placement decisions; environmental impact statement; state highway alignment; public comments process
A. If the department issues a final tier 1 environmental impact statement and record of decision for a new state highway in a county with a population of more than four hundred thousand persons and less than eight hundred thousand persons, the department shall include at least one alternative in the tier 2 phase for further study that both:
1. Services the most populous geographical area with the greatest potential for economic development based on data related to the anticipated opening date of the state highway.
2. Represents feedback received from citizens, stakeholders and resolutions that are adopted by impacted local jurisdictions and that are submitted to the department as public comments.
B. If after December 31, 2020 and before the effective date of this section the department issues a final tier 1 environmental impact statement and record of decision that does not comply with subsection A of this section, the department shall reissue the environmental impact statement and record of decision.
Sec. 2. Delayed repeal
Section 28-7060, Arizona Revised Statutes, as added by this act, is repealed from and after December 31, 2022.
