amending title 36, Arizona Revised Statutes, by adding chapter 33; relating to health care employment.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, Arizona Revised Statutes, is amended by adding chapter 33, to read:

CHAPTER 33

HEALTH CARE EMPLOYMENT

ARTICLE 1. GENERAL PROVISIONS

START_STATUTE36-3301. Definition of noncompete clause

In this chapter, unless the context otherwise requires, "noncompete clause" means a clause in an employment contract with a medical resident or medical fellow that prohibits the employee from working in a specific geographic area for a specific period of time after the EMPLOYEE'S medical residency or medical fellowship ends. START_STATUTE36-3302. Noncompete clause; prohibition

An employer may not require a person who is employed by the employer as a result of a medical residency or medical fellowship matching process to agree to a noncompete clause for any time period after the person's medical residency or medical fellowship ends. END_STATUTE

Sec. 2. Applicability

Section 36-3302, Arizona Revised Statutes, as added by this act, applies to contracts entered into from and after the effective date of this act.
