AN ACT

 

Amending title 28, chapter 7, article 5, Arizona Revised Statutes, by adding section 28‑2157.01; amending title 41, chapter 3, article 1.1, Arizona Revised Statutes, by adding section 41‑511.17; relating to state parks.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 28, chapter 7, article 5, Arizona Revised Statutes, is amended by adding section 28-2157.01, to read:

START_STATUTE28-2157.01.  Vehicle registration; voluntary contribution; delayed repeal

A.  The application for initial registration and for renewal of registration of a motor vehicle shall allow the applicant to affirmatively act to voluntarily donate ten dollars to be used to operate, maintain and make capital improvements to state parks.  If an applicant voluntarily donates monies pursuant to this section, the department shall deposit, pursuant to sections 35‑146 and 35‑147, all of the monies collected pursuant to this section in the sustainable state parks fund established by section 41‑511.17.

B.  This section is repealed from and after June 30, 2013. END_STATUTE

Sec. 2.  Title 41, chapter 3, article 1.1, Arizona Revised Statutes, is amended by adding section 41-511.17, to read:

START_STATUTE41-511.17.  Sustainable state parks fund; delayed repeal

A.  The sustainable state parks fund is established consisting of monies donated pursuant to section 28‑2157.01.  The Arizona state parks board shall administer the fund.  Monies in the fund are continuously appropriated and are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.  The Arizona state parks board shall use these monies to operate, maintain and make capital improvements to state parks.

B.  This section is repealed from and after June 30, 2013. END_STATUTE

Sec. 3.  Audit, sustainable state parks fund

On or before February 1, 2013, the auditor general shall conduct an audit of the sustainable state parks fund established by section 41‑511.17, Arizona Revised Statutes, as added by this act, and shall issue a report of its findings to the appropriations committees in the senate and the house of representatives, or their successor committees.

Sec. 4.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
