AN ACT

 

Amending section 39-126, Arizona Revised Statutes; relating to public records.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 39-126, Arizona Revised Statutes, is amended to read:

START_STATUTE39-126.  Federal risk assessments of infrastructure; confidentiality; exemption of critical energy infrastructure information; privileged information; definitions

A.  Nothing in this chapter requires the disclosure of a risk assessment that is performed by or on behalf of a federal agency to evaluate critical energy, water or telecommunications infrastructure to determine its vulnerability to sabotage or attack.

B.  Notwithstanding any other law, critical energy infrastructure information or critical infrastructure information, including cybersecurity information, that is in the possession of this state, a local agency or commission or another instrumentality of this state or a local government is exempt from inspection, copying or other disclosure requirements of any state or local government law or rule requiring disclosure of information or records.

C.  The disclosure of critical energy infrastructure information or critical infrastructure information to this state, to a state agency or commission or another instrumentality of this state or to a local government does not constitute a waiver of any applicable privilege or protection against disclosure provided under law to the information, such as trade secret protection.

D.  For the purposes of this section:

1.  "Critical energy infrastructure information" has the same meaning prescribed in 18 code of federal regulations section 388.113.

2.  "Critical Infrastructure" has the same meaning prescribed in 42 United States Code section 5195c.

3.  "Local government" means any county, city, town, special district or other political subdivision of this state, including a joint powers or joint action agency and a state educational institution. END_STATUTE
