AN ACT

 

Amending title 40, Arizona Revised Statutes, by adding chapter 8; relating to energy incentives.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 40, Arizona Revised Statutes, is amended by adding chapter 8, to read:

CHAPTER 8

ENERGY INCENTIVES

ARTICLE 1.  GENERAL PROVISIONS

START_STATUTE40-1301.  Political subdivisions; energy incentives; prohibition; definition

A.  This state and any county, city, school district or other political subdivision of this state, or a contractor or third-party vendor of any of these entities, is prohibited from claiming or accepting any incentive or subsidy from or participating in any incentive program of a public utility for the implementation or use of any solar or wind energy device.

B.  For the purposes of this section, "state" means any department, board, commission, institution or other agency of this state, including the universities under the jurisdiction of the Arizona board of regents.END_STATUTE
