AN ACT

 

amending title 42, chapter 13, article 7, Arizona Revised Statutes, by adding section 42‑13301.01; relating to computer data centers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 42, chapter 13, article 7, Arizona Revised Statutes, is amended by adding section 42-13301.01, to read:

START_STATUTE42-13301.01.  Computer data centers; property value

A.  For the 2014 tax year, the full cash value of a computer data center that is certified by the Arizona commerce authority pursuant to section 41‑1519 may not exceed by more than twenty per cent the full cash value of that computer data center for the 2013 tax year, adjusted proportionately if the computer data center had a net increase in square footage during the twelve months before the valuation date.

B.  For the 2014 tax year, the limited property value of a computer data center that is certified by the Arizona commerce authority pursuant to section 41‑1519 may not exceed by more than twenty per cent the limited property value of that computer data center for the 2013 tax year, adjusted proportionately if the computer data center had a net increase in square footage during the twelve months before the valuation date. Sec. 2.  Retroactivity

This act applies retroactively to the 2014 tax year with a valuation date of January 1, 2013.
