HOUSE BILL 2545

 

 

 

AN ACT

 

amending title 33, chapter 9, article 3, Arizona revised Statutes, by adding section 33-1262; amending title 33, chapter 16, article 1, Arizona Revised Statutes, by adding section 33-1817; relating to CONDOMINIUMS and planned communities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 33, chapter 9, article 3, Arizona Revised Statutes, is amended by adding section 33-1262, to read:

START_STATUTE33-1262.  Rental restrictions prohibited

notwithstanding any provision in the condominium documents, an association shall not prohibit the leasing or rental of units in the condominium.  An association shall not require the property owner to provide the association a copy of the lease agreement or charge a fee to the property owner for renting the property.  The association may request the property owner register the tenant with the association but shall not charge a fee for the registration. Sec. 2.  Title 33, chapter 16, article 1, Arizona Revised Statutes, is amended by adding section 33-1817, to read:

START_STATUTE33-1817.  Rental restrictions prohibited

Notwithstanding any provision in the community documents, an association shall not prohibit the leasing or rental of members' properties in the planned community.  An association shall not require the property owner to provide the association a copy of the lease agreement or charge a fee to the property owner for renting the property.  The association may request the property owner register the tenant with the association but shall not charge a fee for the registration.
