AN ACT
amending Title 15, chapter 1, article 5, Arizona Revised Statutes, by adding section 15-153; relating to school buildings.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 1, article 5, Arizona Revised Statutes, is amended by adding section 15-153, to read:
15-153. School buildings near airports; restrictions; exception
A. From and after August 31, 2018, a charter school or school district that is seeking to locate a school within two miles of a public use airport runway shall obtain a determination of no hazard from the federal aviation administration before commencing any construction pursuant to 14 code of federal regulations part 77.
B. This section does not apply to a charter school or district school that exists within two miles of a public use airport runway as of January 1, 2015, unless that charter school seeks to build a new structure.
Sec. 2. Effective date
This act is effective from and after August 31, 2018.
