HOUSE BILL 2488

 

 

 

AN ACT

 

amending section 15‑902.04, Arizona Revised Statutes; relating to school finance.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 15-902.04, Arizona Revised Statutes, is amended to read:

START_STATUTE15-902.04.  Optional two hundred days of instruction; applicability

A.  Subject to the limitations prescribed in subsection D of this section, a school district or charter holder that elects to provide two hundred days of instruction may increase its the school district's, charter holder's or school's base level by five eight per cent.

B.  A school district, an individual school operated by a school district, multiple schools operated by a school district, or a charter holder, an individual charter school operated by a charter holder or multiple charter schools operated by a charter holder that elects elect to provide two hundred days of instruction shall be approved by the department of education on or before November 1 in the fiscal year that precedes the beginning of the fiscal year that the school district, an individual school operated by a school district, multiple schools operated by a school district, a charter holder, an individual charter school operated by a charter holder or multiple charter schools operated by a charter holder are planning on offering instruction for two hundred days and shall obtain approval from the department of education before the beginning of the fiscal year that the school district or the charter holder is planning on offering instruction for two hundred days.  The school district or charter holder shall ensure that the last day of instruction in any school year occurs before June 30.

C.  The school district, an individual school operated by a school district, multiple schools operated by a school district, or a charter school, an individual charter school operated by a charter holder or multiple charter schools operated by a charter holder shall increase its their annual instructional hours by ten per cent in order to receive the base level increase prescribed in this section.

D.  Subsection A of this section applies to a school district or charter holder regardless of the letter grade assigned to the school district or charter holder pursuant to section 15-241 and to:

1.  An individual school operated by a school district if the school is assigned a letter grade of D or F pursuant to section 15‑241 and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection K or S, as applicable.  A  school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241.

2.  Multiple schools operated by a school district if each of those schools is assigned a letter grade of D or F pursuant to section 15‑241 and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection K or S, as applicable.  A school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241.

3.  An individual charter school operated by a charter holder if the charter school is assigned a letter grade of D or F pursuant to section 15‑241 and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection m or u, as applicable.  A charter school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the charter school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241.

4.  Multiple charter schools operated by a charter holder if each of those charter schools is assigned a letter grade of D or F pursuant to SECTION 15‑241 and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection m or u, as applicable.  A charter school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the charter school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241. Sec. 2.  Optional two hundred days of instruction; eligibility for additional base level increase in fiscal year 2013‑2014; applicability

A.  Notwithstanding section 15‑902.04, Arizona Revised Statutes, as amended by this act, and subject to the limitations prescribed in subsection C of this section, a school district, an individual school operated by a school district, multiple schools operated by a school district, a charter holder, an individual charter school operated by a charter holder or multiple charter schools operated by a charter holder that elect to provide two hundred days of instruction are not eligible to increase their base level by eight per cent in fiscal year 2013‑2014 unless both of the following occur:

1.  The school district or charter holder has previously obtained approval to offer two hundred days of instruction from the department of education on or before November 1, 2012.

2.  The department of education approves that school district or charter holder to offer two hundred days of instruction for fiscal year 2013‑2014.

B.  Notwithstanding section 15‑902.04, Arizona Revised Statutes, as amended by this act, and subject to the limitations prescribed in subsection C of this section, a school district, an individual school operated by a school district, multiple schools operated by a school district, a charter holder, an individual charter school operated by a charter holder or multiple charter schools operated by a charter holder that are approved by the department of education to offer two hundred days of instruction but that do not meet the conditions prescribed in subsection A of this section are only eligible to increase the base level by five per cent in fiscal year 2013‑2014. 

C.  Subsections A and B of this section apply to a school district or charter holder regardless of the letter grade assigned to the school district or charter holder pursuant to section 15-241 and to:

1.  An individual school operated by a school district if the school is assigned a letter grade of D or F pursuant to section 15‑241, Arizona Revised Statutes, and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection K or S, Arizona Revised Statutes, as applicable.  A school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241, Arizona Revised Statutes.

2.  Multiple schools operated by a school district if each of those schools is assigned a letter grade of D or F pursuant to section 15‑241, Arizona Revised Statutes, and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection K or S, Arizona Revised Statutes, as applicable.  A school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241, Arizona Revised Statutes.

3.  An individual charter school operated by a charter holder if the charter school is assigned a letter grade of D or F pursuant to section 15‑241, Arizona Revised Statutes, and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15-241, subsection M or U, Arizona Revised Statutes, as applicable.  A  charter school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the charter school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241, Arizona Revised Statutes.

4.  Multiple charter schools operated by a charter holder if each of those charter schools is assigned a letter grade of D or F pursuant to section 15‑241, Arizona Revised Statutes, and has incorporated two hundred days of instruction into its improvement plan submitted pursuant to section 15‑241, subsection M or U, Arizona Revised Statutes, as applicable.  A charter school that initially met the requirements of this paragraph may continue to provide two hundred days of instruction after the charter school is subsequently assigned a letter grade other than D or F pursuant to section 15‑241, Arizona Revised Statutes.

Sec. 3.  School improvement plan; two hundred instructional days

The state board of education shall identify the components an individual school within a school district or an individual charter school operated by a charter holder must include in a school improvement plan submitted pursuant to section 15‑241, Arizona Revised Statutes, in order to offer two hundred days of instruction pursuant to this act.
