HOUSE BILL 2464

 

 

 

AN ACT

 

amending Laws 2010, seventh special session, chapter 7, section 6; amending sections 41-511 and 41-511.02, Arizona Revised Statutes; relating to state parks.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Laws 2010, seventh special session, chapter 7, section 6, is amended to read:

Sec. 6.  Law enforcement and boating safety fund; Arizona state parks board; operating expenditures

Notwithstanding section 5‑383, Arizona Revised Statutes:

1.  For fiscal year 2010‑2011, available monies in the law enforcement and boating safety fund may only be granted to La Paz, and Mohave and yuma counties.

2.  All law enforcement and boating safety fund monies appropriated by the legislature to the Arizona state parks board in fiscal year 2010‑2011 above $500,000 are available in fiscal year 2010‑2011 for the operation of state parks.

Sec. 2.  Section 41-511, Arizona Revised Statutes, is amended to read:

START_STATUTE41-511.  Arizona state parks board; membership; appointment; terms

A.  There shall be an Arizona state parks board, which shall consist of seven members.  The state land commissioner shall be a member and the remaining members, each of whom shall be a bona fide resident of the this state, shall be appointed by the governor pursuant to section 38‑211 to serve at the pleasure of the governor.  The appointive members shall be selected because of their knowledge of and interest in outdoor activities, multiple use of lands, archaeology, natural resources and the value of the historical aspects of Arizona, and because of their interest in the conservation of natural resources.  Not less than two of the appointive members shall be representative of the livestock industry, and one appointive member shall be professionally engaged in general recreation work.

B.  Of the members first appointed, one shall serve for a term expiring the first Monday in January following the effective date of this article, and one each for terms expiring one, two, three, four and five years thereafter. Thereafter, All appointments shall be for a full term of six years, except that those appointments to fill a vacancy shall be for the remainder of the term, and shall expire on the third Monday in January of the appropriate year. Sec. 3.  Section 41-511.02, Arizona Revised Statutes, is amended to read:

START_STATUTE41-511.02.  Director; qualifications; state historic preservation officer

A.  The board governor shall employ appoint a full‑time director pursuant to section 38‑211 who shall:

1.  Not be one of its the members of the board.

2.  Serve at the pleasure of the board governor.

3.  Be qualified by successful experience in administration in business or in government.

4.  Have a knowledge of or training in the multiple use of lands and the conservation of natural resources.

B.  The governor shall designate a full‑time employee of the board with professional competence and expertise in the field of historic preservation as the "state historic preservation officer" to administer the state historic preservation program. END_STATUTE

Sec. 4.  Lease of state parks; park enterprise fund; definitions

A.  The Arizona state parks board established by title 41, chapter 3, article 1.1, Arizona Revised Statutes, shall enter into a lease agreement with an incorporated city or town that is adjacent to a state park that provides fishing and boating facilities along the Colorado river to lease that state park.

B.  If agreed to by the city or town, the lease agreement shall include the following provisions:

1.  The lease agreement between the Arizona state parks board and the incorporated city or town shall be for a period of fifteen years.

2.  The incorporated city or town shall establish a park enterprise fund as a separate account from all other accounts of the city or town and the park enterprise fund shall not contain any other city or town monies except as provided by this subsection.  The incorporated city or town shall use the monies in the park enterprise fund for maintenance, operation and improvement of the state park.

3.  A requirement that the incorporated city or town is entitled to receive no more than one hundred thousand dollars per fiscal year of park profits as a reimbursement for capital expenditures on the park by the incorporated city or town, but not to exceed the total capital expenditures made by the incorporated city or town.

4.  The park enterprise fund is entitled to receive fifty per cent of all remaining park profits in a fiscal year and the incorporated city or town shall transmit fifty per cent of all remaining park profits in a fiscal year to the Arizona state parks board for deposit in the state parks fund established pursuant to section 41‑511.11, Arizona Revised Statutes.

5.  Any monies remaining in the park enterprise fund at the termination of the lease revert to the state parks fund established pursuant to section 41-511.11, Arizona Revised Statutes.

C.  For the purposes of this section:

1.  "Expenses" means all costs to maintain the state park.

2.  "Gross revenues" means all gate receipts, excluding special event gate receipts, and all revenues obtained from concessionaires.

3.  "Park profits" means gross revenues minus expenses.

Sec. 5.  State parks board; emergency procurements; management of state parks; sale of state parks; delayed repeal

A.  Notwithstanding section 41‑2537, Arizona Revised Statutes, the director of the department of administration shall authorize the Arizona state parks board to make emergency procurements for contracts from a public or private entity to:

1.  Assist in the operation, management or maintenance of one or more state parks.

2.  Completely operate, manage or maintain one or more state parks.

B.  Notwithstanding any other law, the Arizona state parks board shall provide for the sale of a state park to its aboriginal inhabitants with the sale proceeds to be deposited in a dedicated fund to be used solely for the maintenance and operation of the park.  On purchase of the park from this state, the purchaser shall execute a lease agreement with this state to allow for the state's continued use and operation of the park.

C.  This section is repealed from and after June 30, 2011.

Sec. 6.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
