AN ACT

 

amending title 12, chapter 5, article 1, Arizona Revised Statutes, by adding section 12-512; relating to punitive damages.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 12, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 12-512, to read:

START_STATUTE12-512.  Punitive damages; evidence required; proportionality of award

A.  A person is not liable for Punitive or exemplary damages unless there is clear and convincing evidence that the person acted with actual malice.

B.  If punitive or exemplary damages are awarded, the amount of the punitive or exemplary damages shall be proportionate to the actual damages. END_STATUTE
